A bill for an act
relating to pet animals; requiring product labeling and notice for retail sales of
products containing xylitol; proposing coding for new law in Minnesota Statutes,
chapter 325E.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin A manufacturer, distributor, or wholesaler may not offer for
sale in this state a product containing xylitol unless it contains labeling that satisfies the
rules adopted under subdivision 2.

new text begin The Board of Veterinary Medicine shall adopt rules by January 1, 2018,
establishing uniform labeling requirements for products containing xylitol that adequately
warn the public of the toxicity of these products to pets.

new text begin Retail notice. new text end

new text begin (a) A person who sells a product containing xylitol at retail must
post the notice in paragraph (b) in a manner clearly visible to a consumer examining a
product containing xylitol offered for sale.

new text begin (b) The notice must be in 36-point type or larger and state:
new text end

new text begin "The ingestion of xylitol is poisonous to pets. If a pet has eaten a product containing
xylitol, you should immediately contact a veterinarian or the Animal Poison Control Center
at (888) 426-4435."

new text begin (c) A retailer may include additional language in the notice in order to promote the sale
of a product containing xylitol, provided that the language in paragraph (b) is present.
