  1.1                          A bill for an act 
  1.2             relating to water; providing that a portion of the 
  1.3             environment and natural resources trust fund may be 
  1.4             used for grants to local units of government for 
  1.5             upgrading individual sewage treatment systems and 
  1.6             wells; amending Minnesota Statutes 1996, section 
  1.7             116P.08, subdivisions 1 and 2. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 116P.08, 
  1.10  subdivision 1, is amended to read: 
  1.11     Subdivision 1.  [EXPENDITURES.] Money in the trust fund may 
  1.12  be spent only for: 
  1.13     (1) the reinvest in Minnesota program as provided in 
  1.14  section 84.95, subdivision 2; 
  1.15     (2) research that contributes to increasing the 
  1.16  effectiveness of protecting or managing the state's environment 
  1.17  or natural resources; 
  1.18     (3) collection and analysis of information that assists in 
  1.19  developing the state's environmental and natural resources 
  1.20  policies; 
  1.21     (4) enhancement of public education, awareness, and 
  1.22  understanding necessary for the protection, conservation, 
  1.23  restoration, and enhancement of air, land, water, forests, fish, 
  1.24  wildlife, and other natural resources; 
  1.25     (5) capital projects for the preservation and protection of 
  1.26  unique natural resources; 
  2.1      (6) activities that preserve or enhance fish, wildlife, 
  2.2   land, air, water, and other natural resources that otherwise may 
  2.3   be substantially impaired or destroyed in any area of the state; 
  2.4      (7) grants to local units of government for upgrading or 
  2.5   replacing individual sewage treatment systems, building 
  2.6   subordinate service district and cluster systems, water 
  2.7   filterization, and sealing existing wells; 
  2.8      (8) administrative and investment expenses incurred by the 
  2.9   state board of investment in investing deposits to the trust 
  2.10  fund; and 
  2.11     (8) (9) administrative expenses subject to the limits in 
  2.12  section 116P.09. 
  2.13     Sec. 2.  Minnesota Statutes 1996, section 116P.08, 
  2.14  subdivision 2, is amended to read: 
  2.15     Subd. 2.  [EXCEPTIONS.] Money from the trust fund may not 
  2.16  be spent for: 
  2.17     (1) purposes of environmental compensation and liability 
  2.18  under chapter 115B and response actions under chapter 115C; 
  2.19     (2) purposes of municipal water pollution control under the 
  2.20  authority of chapters 115 and 116, including combined sewer 
  2.21  overflow under section 116.162, but not including projects under 
  2.22  subdivision 1, clause (7); 
  2.23     (3) costs associated with the decommissioning of nuclear 
  2.24  power plants; 
  2.25     (4) hazardous waste disposal facilities; 
  2.26     (5) solid waste disposal facilities; or 
  2.27     (6) projects or purposes inconsistent with the strategic 
  2.28  plan.
