A bill for an act
relating to drivers' licenses; modifying requirements for accepting driver's license
from another state or jurisdiction as valid form of identification; amending
Minnesota Statutes 2006, section 171.06, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 171.06, is amended by adding a
subdivision to read:

new text begin When documenting or
proving identity in an application for a license, the commissioner may not accept a driver's
license from a state or jurisdiction outside of Minnesota that allows issuance of a driver's
license without documented proof of lawful residency in the United States. If a state
or jurisdiction allows issuance of a driving privilege card without documented proof
of lawful residency in the United States, and the card is not considered a valid form of
identification by the issuing state, the commissioner shall accept a driver's license but not a
driving privilege card from that state for documenting or proving identity in an application
for a Minnesota license. For purposes of this section, "license" means a temporary license,
instruction permit, provisional license, or driver's license.

Sec. 2. new text begin RULEMAKING; DRIVER'S LICENSE FROM ANOTHER STATE OR
JURISDICTION.

new text begin As required under section 1, the commissioner of public safety must amend
Minnesota Rules, part 7410.0400, subpart 3, to exclude a driver's license from the
following states as a valid secondary document: Hawaii, Maine, Maryland, Michigan,
New Mexico, and Oregon. The commissioner may amend the rules using the good cause
exemption in Minnesota Statutes, section 14.388, under authority of section 14.388,
subdivision 1, clause (3).
