  1.1                          A bill for an act 
  1.2             relating to education; making school safety 
  1.3             improvements eligible for health and safety revenue; 
  1.4             amending Minnesota Statutes 1998, section 123B.57, 
  1.5             subdivisions 1 and 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 123B.57, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [HEALTH AND SAFETY PROGRAM.] (a) To receive 
  1.10  health and safety revenue for any fiscal year a district must 
  1.11  submit to the commissioner an application for aid and levy by 
  1.12  the date determined by the commissioner.  The application may be 
  1.13  for: 
  1.14     (1) hazardous substance removal,; 
  1.15     (2) fire and life safety code repairs,; 
  1.16     (3) labor and industry regulated facility and equipment 
  1.17  violations, and; 
  1.18     (4) health, safety, and environmental management, including 
  1.19  indoor air quality management; and 
  1.20     (5) pupil and staff personal safety activities.  
  1.21     (b) The application must include a health and safety 
  1.22  program adopted by the school district board.  The program must 
  1.23  include the estimated cost, per building, of the program by 
  1.24  fiscal year. 
  1.25     Sec. 2.  Minnesota Statutes 1998, section 123B.57, 
  2.1   subdivision 2, is amended to read: 
  2.2      Subd. 2.  [CONTENTS OF PROGRAM.] A district must adopt a 
  2.3   health and safety program.  The program must include plans, 
  2.4   where applicable, for hazardous substance removal, fire and life 
  2.5   safety code repairs, regulated facility and equipment 
  2.6   violations, and health, safety, and environmental management, 
  2.7   including indoor air quality management, and pupil and staff 
  2.8   safety enhancements.  
  2.9      (a) A hazardous substance plan must contain provisions for 
  2.10  the removal or encapsulation of asbestos from school buildings 
  2.11  or property, asbestos-related repairs, cleanup and disposal of 
  2.12  polychlorinated biphenyls found in school buildings or property, 
  2.13  and cleanup, removal, disposal, and repairs related to storing 
  2.14  heating fuel or transportation fuels such as alcohol, gasoline, 
  2.15  fuel, oil, and special fuel, as defined in section 296A.01.  If 
  2.16  a district has already developed a plan for the removal or 
  2.17  encapsulation of asbestos as required by the federal Asbestos 
  2.18  Hazard Emergency Response Act of 1986, the district may use a 
  2.19  summary of that plan, which includes a description and schedule 
  2.20  of response actions, for purposes of this section.  The plan 
  2.21  must also contain provisions to make modifications to existing 
  2.22  facilities and equipment necessary to limit personal exposure to 
  2.23  hazardous substances, as regulated by the federal Occupational 
  2.24  Safety and Health Administration under Code of Federal 
  2.25  Regulations, title 29, part 1910, subpart Z; or is determined by 
  2.26  the commissioner to present a significant risk to district staff 
  2.27  or student health and safety as a result of foreseeable use, 
  2.28  handling, accidental spill, exposure, or contamination. 
  2.29     (b) A fire and life safety plan must contain a description 
  2.30  of the current fire and life safety code violations, a plan for 
  2.31  the removal or repair of the fire and life safety hazard, and a 
  2.32  description of safety preparation and awareness procedures to be 
  2.33  followed until the hazard is fully corrected. 
  2.34     (c) A facilities and equipment violation plan must contain 
  2.35  provisions to correct health and safety hazards as provided in 
  2.36  department of labor and industry standards pursuant to section 
  3.1   182.655.  
  3.2      (d) A health, safety, and environmental management plan 
  3.3   must contain a description of training, recordkeeping, hazard 
  3.4   assessment, and program management as defined in section 123B.56.
  3.5      (e) A plan to test for and mitigate radon produced hazards. 
  3.6      (f) A plan to monitor and improve indoor air quality. 
  3.7      (g) A pupil and staff personal safety plan may include any 
  3.8   of the following activities: 
  3.9      (1) peer mediation; 
  3.10     (2) enhanced security activities in school parking lots, 
  3.11  hallways, and for after-school events; 
  3.12     (3) police liaison officer activities in each building; 
  3.13     (4) at-risk pupil counseling services; 
  3.14     (5) installation of monitoring and communications devices 
  3.15  such as cameras, radios, pagers, and cell phones; and 
  3.16     (6) school building modifications such as electronic doors. 
  3.17     A school district's total eligible expenditures for pupil 
  3.18  and staff personal safety activities must not exceed $30 per 
  3.19  adjusted marginal cost pupil unit.  Revenue for pupil and staff 
  3.20  personal safety activities must be provided entirely through 
  3.21  state aid. 
  3.22     Sec. 3.  [EFFECTIVE DATE.] 
  3.23     Sections 1 and 2 are effective for revenue for fiscal years 
  3.24  2001 and later.
