  1.1                          A bill for an act
  1.2             relating to education; establishing a low-income 
  1.3             concentration levy program; proposing coding for new 
  1.4             law in Minnesota Statutes, chapter 124. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [124.305] [LOW-INCOME CONCENTRATION LEVY 
  1.7   PROGRAM.] 
  1.8      Subdivision 1.  [ELIGIBILITY.] A school building qualifies 
  1.9   for the low-income concentration program if: 
  1.10     (1) at least 20 percent of the enrolled students are 
  1.11  eligible to receive free or reduced price lunch based on the 
  1.12  enrollment counts for the previous year; 
  1.13     (2) at least 20 percent of the enrolled students are 
  1.14  students of color based on the enrollment counts for the 
  1.15  previous year; and 
  1.16     (3) the school building is located in a school district 
  1.17  that is not wholly located within the boundaries of a city of 
  1.18  the first class. 
  1.19     Subd. 2.  [LEVY.] Each year, a school district may levy an 
  1.20  amount equal to: 
  1.21     (1) $286; times 
  1.22     (2) the ratio of the basic formula allowance under section 
  1.23  124A.22, subdivision 2, for the current year to $3,530; times 
  1.24     (3) the number of children eligible to receive free or 
  1.25  reduced price lunch for the previous year enrolled at each 
  2.1   qualifying site within the district. 
  2.2      Subd. 3.  [REVENUE USES.] Low-income concentration revenue 
  2.3   must be used for the purposes listed in section 124A.28, 
  2.4   subdivision 1a. 
  2.5      Sec. 2.  [EFFECTIVE DATE.] 
  2.6      Section 1 is effective July 1, 1998, for levies payable in 
  2.7   1999 and later.
