relating to health; providing for availability of COVID-19 vaccines for school
employees.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin AVAILABILITY OF COVID-19 VACCINES TO SCHOOL EMPLOYEES.

new text begin (a) The terms defined in this subdivision apply to this section.

new text begin (b) "Contract employee" means an employee of an organization that provides
student-related services throughout the school year to a school, whose primary task is to
provide services to students attending a school.

new text begin (c) "COVID-19 vaccine" means a vaccine against severe acute respiratory syndrome
coronavirus 2 (SARS-CoV-2).

new text begin (d) "School administrator" means a school superintendent, principal, assistant principal,
or other person having general control and supervision of a school.

new text begin (e) "Teacher" means a classroom teacher or other school employee required to hold a
license from the Professional Educator Licensing and Standards Board.

new text begin The provisions in this section shall apply notwithstanding any
law, rule, executive order, or agency guidance to the contrary.

new text begin COVID-19 vaccine availability. new text end

new text begin In the state strategy for COVID-19 vaccine
distribution in Minnesota, the commissioner of health shall make COVID-19 vaccines
available to teachers, school administrators, education paraprofessionals, and other school
employees, including contract employees, in the distribution phase in which COVID-19
vaccines are made available to frontline essential workers, as identified by the commissioner.

new text begin A teacher, school administrator, education
paraprofessional, or other school employee, including a contract employee, shall not be
required to obtain a COVID-19 vaccine in order to provide services on an in-person basis
at a public school. A student shall not be required to obtain a COVID-19 vaccine in order
to receive instruction on an in-person basis at a public school, or to enroll in or remain
enrolled in a public school.
