  1.1                          A bill for an act 
  1.2             relating to state lands; authorizing conveyance or 
  1.3             sale of certain tax-forfeited lands that border on 
  1.4             public water or natural wetlands in Anoka county. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [CONVEYANCE OF TAX-FORFEITED LAND BORDERING ON 
  1.7   PUBLIC WATER; ANOKA COUNTY.] 
  1.8      (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  1.9   282.018, subdivision 1, and the public sale provisions of 
  1.10  Minnesota Statutes, chapter 282, Anoka county may convey the 
  1.11  tax-forfeited lands bordering public water that are described in 
  1.12  paragraph (c) to the cities in which the lands are located under 
  1.13  the remaining provisions of Minnesota Statutes, chapter 282. 
  1.14     (b) The conveyances must be in a form approved by the 
  1.15  attorney general and must provide that the lands revert to the 
  1.16  state if they are not used for park and open-space purposes.  No 
  1.17  landscape changes, stormwater discharge, or watercourse 
  1.18  alterations that affect the hydrology and vegetative 
  1.19  characteristics of the lands are allowed beyond those conditions 
  1.20  that exist at the time of the conveyance in order that the 
  1.21  wetland characteristics and resulting wildlife habitats are 
  1.22  maintained in perpetuity. 
  1.23     (c) The lands that may be conveyed are located in Anoka 
  1.24  county and are described as follows: 
  1.25     (1) City of Coon Rapids, (PIN No. 14-31-24-43-0025) that 
  2.1   part of the Southeast Quarter of the Southwest Quarter and that 
  2.2   part of the Southwest Quarter of the Southeast Quarter in 
  2.3   Section 14, Township 31 North, Range 24 West, Anoka county, 
  2.4   Minnesota, described as follows:  Commencing at the northwest 
  2.5   corner of said Southeast Quarter of the Southwest Quarter; 
  2.6   thence due East (assumed bearing) along the north line of said 
  2.7   Southeast Quarter of the Southwest Quarter, a distance of 680 
  2.8   feet; thence South 7 degrees 16 minutes East 720.7 feet to the 
  2.9   actual point of beginning of the tract of land to be described; 
  2.10  thence South 87 degrees 06 minutes East to the centerline of 
  2.11  Coon Creek; thence northerly, westerly and northwesterly along 
  2.12  the centerline of said creek to the north line of said Southeast 
  2.13  Quarter of the Southwest Quarter; thence East along said north 
  2.14  line to the southwesterly right-of-way line of United States 
  2.15  Highway No. 10; thence southeasterly along said highway 
  2.16  right-of-way line to the westerly railroad right-of-way line of 
  2.17  Burlington Northern, Inc.; thence southerly along said railroad 
  2.18  right-of-way line to the south line of said Southwest Quarter of 
  2.19  the Southeast Quarter; thence west along the south line of said 
  2.20  Southwest Quarter of the Southeast Quarter and along the south 
  2.21  line of said Southeast Quarter of the Southwest Quarter to the 
  2.22  southwest corner of said Southeast Quarter of the Southwest 
  2.23  Quarter; thence north along the west line of said Southeast 
  2.24  Quarter of the Southwest Quarter to a point distant 900 feet 
  2.25  south of the initial point of commencement, as measured along 
  2.26  the west line of said Southeast Quarter of the Southwest 
  2.27  Quarter; thence East and parallel with the north line of said 
  2.28  Southeast Quarter of the Southwest Quarter to an intersection 
  2.29  with a line drawn southerly from the actual point of beginning 
  2.30  and parallel with the west line of said Southeast Quarter of the 
  2.31  Southwest Quarter, thence northerly to the actual point of 
  2.32  beginning; EXCEPT that part platted as Robinson's Preserve, 
  2.33  Anoka county, Minnesota; 
  2.34     (2) City of St. Francis, (PIN No. 05-33-24-13-0001) Lot 14, 
  2.35  Oak Grove River Lots, Anoka county, Minnesota; and 
  2.36     (3) City of St. Francis, (PIN No. 05-33-24-13-0002) Lot 15, 
  3.1   Oak Grove River Lots, Anoka county, Minnesota. 
  3.2      (d) The county has determined that its land management 
  3.3   interests would best be served if the lands were retained in 
  3.4   public ownership and conveyed to the cities in which the lands 
  3.5   are located. 
  3.6      Sec. 2.  [CONVEYANCE OF TAX-FORFEITED LAND BORDERING ON 
  3.7   PUBLIC WATER; ANOKA COUNTY.] 
  3.8      (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  3.9   282.018, subdivision 1, and the public sale provisions of 
  3.10  Minnesota Statutes, chapter 282, Anoka county may convey the

  3.25     (1) City of St. Francis (PIN No. 32-34-24-31-0016) all that 
  3.26  part of Outlot 19, Village of St. Francis, Anoka county, 
  3.27  Minnesota, lying westerly of the westerly right-of-way line of 
  3.28  Butterfield Drive; EXCEPT the south 190.00 feet of the west 
  3.29  150.00 feet of said Outlot 19; ALSO EXCEPT the north 100.00 feet 
  3.30  of the south 300.00 feet of the west 150.00 feet of said Outlot 
  3.31  19; ALSO EXCEPT all that part of said Outlot 19 described as 
  3.32  follows:  Commencing at the northeast corner of Lot 6, Block 5, 
  3.33  Village of St. Francis; thence north along said westerly 
  3.34  right-of-way line of Butterfield Drive 749.74 feet, more or 
  3.35  less, to the north line of said Outlot 19; thence westerly along 
  3.36  said north line 230.00 feet to the point of beginning; thence 
  4.1   continue westerly along said north line to the northeast corner 
  4.2   of Outlot 18, Village of St. Francis; thence south along the 
  4.3   east line of said Outlot 18 to the southeast corner thereof; 
  4.4   thence west along the south line of said Outlot 18 a distance of 
  4.5   81.00 feet; thence south at right angles 284.74 feet; thence 
  4.6   east at right angles 341.00 feet, more or less, to a point 
  4.7   230.00 feet west of said westerly right-of-way line of 
  4.8   Butterfield Drive, as measured along said north line of Outlot 
  4.9   19; thence north to the actual point of beginning; ALSO EXCEPT 
  4.10  all that part of said Outlot 19 described as follows:  Beginning 
  4.11  at the northeast corner of said Lot 6, Block 5, Village of St. 
  4.12  Francis; thence north along said westerly right-of-way line of 
  4.13  Butterfield Drive 749.74 feet, more or less, to said north line 
  4.14  of Outlot 19; thence westerly along said north line 230.00 feet; 
  4.15  thence southerly parallel with said westerly right-of-way line 
  4.16  749.74 feet, more or less, to the south line of said Outlot 19; 
  4.17  thence easterly 230.00 feet, more or less, to the point of 
  4.18  beginning; and 
  4.19     (2) City of Ramsey, (PIN No. 26-32-25-42-0017) Outlot B, 
  4.20  Chestnut Hill, Anoka county, Minnesota. 
  4.21     (d) The county has determined that its land management 
  4.22  interests would best be served if the lands were conveyed to the 
  4.23  cities in which they are located. 
  4.24     Sec. 3.  [CONVEYANCE OR SALE OF TAX-FORFEITED LAND 
  4.25  BORDERING ON PUBLIC WATER OR NATURAL WETLANDS; ANOKA COUNTY.] 
  4.26     (a) Notwithstanding Minnesota Statutes, sections 92.45, 
  4.27  103F.535, and 282.018, subdivision 1, and the public sale 
  4.28  provisions of Minnesota Statutes, chapter 282, Anoka county may 
  4.29  convey the tax-forfeited lands bordering public water or natural 
  4.30  wetlands that are described in paragraph (c) to the cities in 
  4.31  which the lands are located, or may sell the lands to adjoining 
  4.32  landowners, under the remaining provisions of Minnesota 
  4.33  Statutes, chapter 282. 
  4.34     (b) The conveyances or sales must be in a form approved by 
  4.35  the attorney general.  If the lands are conveyed to the cities 
  4.36  in which they are located, the conveyances must provide that the 
  5.1   lands revert to the state if they are not used for open-space 
  5.2   purposes.  If the land described in paragraph (c), clause (1), 
  5.3   is sold to adjoining landowners, a conservation easement, 
  5.4   providing for no further development and in a form prescribed by 
  5.5   the department of natural resources, must be reserved to the 
  5.6   state.  If the land described in paragraph (c), clause (2), is 
  5.7   sold to adjoining landowners, a conservation easement in a form 
  5.8   prescribed by the department of natural resources must be 
  5.9   reserved to the state.  
  5.10     (c) The lands that may be conveyed are located in Anoka 
  5.11  county and are described as follows: 
  5.12     (1) City of Lino Lakes, (PIN No. 11-31-22-34-0007) all that 
  5.13  part of Lot 6, Auditors Subdivision Number 55, Revised, Anoka 
  5.14  county, Minnesota lying westerly of the westerly right-of-way 
  5.15  line of Peltier Lake Drive and lying southerly of the following 
  5.16  described line:  Beginning at the northeast corner of said Lot 
  5.17  6; thence West along the north line of said Lot 6 a distance of 
  5.18  93.50 feet; thence South 05 degrees 49 minutes 00 seconds West 
  5.19  along said westerly right-of-way line of Peltier Lake Drive 
  5.20  300.00 feet; thence West parallel with said north line of Lot 6 
  5.21  a distance of 86.68 feet to the easterly line of land held by 
  5.22  the St. Paul Water Department; thence South 06 degrees 16 
  5.23  minutes 00 seconds East along said easterly line 35.03 feet to 
  5.24  the point of beginning of the line to be described; thence East 
  5.25  parallel with said north line of Lot 6 a distance of 79.31 feet 
  5.26  to said westerly right-of-way line of Peltier Lake Drive and 
  5.27  there terminating; and 
  5.28     (2) City of Fridley, (PIN No. 15-30-24-11-0034) Tract D, 
  5.29  Registered Land Survey No. 51, Anoka county, Minnesota. 
  5.30     (d) The county has determined that its land management 
  5.31  interests would best be served if the lands were retained in 
  5.32  public ownership and conveyed to the cities in which the lands 
  5.33  are located or sold to adjoining landowners.  
  5.34     Sec. 4.  [CONVEYANCE OR SALE OF TAX-FORFEITED LAND 
  5.35  BORDERING ON PUBLIC WATER OR NATURAL WETLANDS; ANOKA COUNTY.] 
  5.36     (a) Notwithstanding Minnesota Statutes, sections 92.45, 
  6.1   103F.535, and 282.018, subdivision 1, and the public sale 
  6.2   provisions of Minnesota Statutes, chapter 282, Anoka county may 
  6.3   convey the tax-forfeited lands bordering public water or natural 
  6.4   wetlands that are described in paragraph (c) to a governmental 
  6.5   subdivision or may sell the lands to adjoining landowners under 
  6.6   the remaining provisions of Minnesota Statutes, chapter 282. 
  6.7      (b) The conveyances or sales must be in a form approved by 
  6.8   the attorney general.  If the lands are conveyed to a 
  6.9   governmental subdivision, the conveyance must provide that the 
  6.10  lands revert to the state if they are not used for open-space 
  6.11  purposes.  If the lands are conveyed to adjoining landowners, a 
  6.12  conservation easement in a form prescribed by the department of 
  6.13  natural resources must be reserved to the state.  
  6.14     (c) The lands that may be conveyed are located in Anoka 
  6.15  county and are described as follows: 
  6.16     (1) City of Coon Rapids, (PIN No. 09-31-24-11-0009) the 
  6.17  West Half of the following described property:  That part of the 
  6.18  East Half of the Northeast Quarter of Section 9, Township 31 
  6.19  North, Range 24 West, Anoka county, Minnesota, described as 
  6.20  follows:  Beginning at a point on the east line thereof distant 
  6.21  825.00 feet south from the northeast corner of said Section 9; 
  6.22  thence South along said east line 660.00 feet; thence West 
  6.23  1,320.00 feet; thence North 660.00 feet; thence East 1,320.00 
  6.24  feet to the point of beginning; and 
  6.25     (2) City of Oak Grove, (PIN No. 08-33-24-24-0001) an island 
  6.26  lying in the Southeast Quarter of the Northwest Quarter of 
  6.27  Section 8, Township 33 North, Range 24 West, Anoka county, 
  6.28  Minnesota, said island being located in the Rum river. 
  6.29     (d) The county has determined that its land management 
  6.30  interests would best be served if the lands were retained in 
  6.31  public ownership and conveyed to a governmental subdivision or 
  6.32  sold to adjoining landowners.  
  6.33     Sec. 5.  [EFFECTIVE DATE.] 
  6.34     Sections 1 to 4 are effective the day following final 
  6.35  enactment.
