  1.1                          A bill for an act 
  1.2             relating to fire safety; requiring smoke detectors 
  1.3             connected to centralized power source in dwelling 
  1.4             units and guest rooms that are not owner-occupied; 
  1.5             amending Minnesota Statutes 2000, section 299F.362, 
  1.6             subdivisions 3, 4, 5. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 299F.362, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [SMOKE DETECTOR FOR ANY DWELLING.] Every dwelling 
  1.11  unit within a dwelling shall be provided with a smoke detector 
  1.12  meeting the requirements of Underwriters Laboratories, Inc., or 
  1.13  approved by the International Conference of Building Officials.  
  1.14  The detector shall be mounted in accordance with the rules 
  1.15  regarding smoke detector location promulgated under the 
  1.16  provisions of subdivision 2.  When actuated, the detector shall 
  1.17  provide an alarm in the dwelling unit.  In every dwelling unit 
  1.18  in which the occupant is not the owner of the dwelling unit, 
  1.19  each smoke detector must be attached to a centralized power 
  1.20  source. 
  1.21     Sec. 2.  Minnesota Statutes 2000, section 299F.362, 
  1.22  subdivision 4, is amended to read: 
  1.23     Subd. 4.  [SMOKE DETECTOR FOR APARTMENT, LODGING HOUSE, OR 
  1.24  HOTEL.] Every dwelling unit within an apartment house and every 
  1.25  guest room in a lodging house or hotel used for sleeping 
  1.26  purposes shall be provided with a smoke detector conforming to 
  2.1   the requirements of Underwriters Laboratories, Inc., or approved 
  2.2   by the International Conference of Building Officials.  In 
  2.3   dwelling units, detectors shall be mounted in accordance with 
  2.4   the rules regarding smoke detector location promulgated under 
  2.5   the provisions of subdivision 2.  When actuated, the detector 
  2.6   shall provide an alarm in the dwelling unit or guest room.  In 
  2.7   every dwelling unit or guest room in which the occupant is not 
  2.8   the owner of the dwelling unit or guest room, each smoke 
  2.9   detector must be attached to a centralized power source. 
  2.10     Sec. 3.  Minnesota Statutes 2000, section 299F.362, 
  2.11  subdivision 5, is amended to read: 
  2.12     Subd. 5.  [INSTALLATION AND MAINTENANCE RESPONSIBILITIES.] 
  2.13  For all occupancies covered by this section where the occupant 
  2.14  is not the owner of the dwelling unit or the guest room, the 
  2.15  owner is responsible for installation and maintenance of the 
  2.16  smoke detectors.  An owner may file inspection and maintenance 
  2.17  reports with the local fire marshal for establishing evidence of 
  2.18  installation, inspection, and maintenance of smoke detectors. 
  2.19     Sec. 4.  [EFFECTIVE DATE.] 
  2.20     Sections 1 to 3 are effective January 1, 2003, and apply to 
  2.21  new and existing dwelling units and guest rooms.
