  1.1                          A bill for an act 
  1.2             relating to metropolitan government; providing 
  1.3             additional oversight responsibilities for the 
  1.4             Legislative Commission on Metropolitan Government; 
  1.5             amending Minnesota Statutes 2002, sections 3.8841, by 
  1.6             adding subdivisions; 473.246. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 3.8841, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 10.  [POWERS; DUTIES; METROPOLITAN COUNCIL REVIEW OF 
  1.11  COMPREHENSIVE PLANS; OVERSIGHT.] The commission must monitor, 
  1.12  review, and make recommendations to the Metropolitan Council and 
  1.13  the legislature with regard to all cases in which the 
  1.14  Metropolitan Council requires a local governmental unit to 
  1.15  modify any comprehensive plan under section 473.175. 
  1.16     Sec. 2.  Minnesota Statutes 2002, section 3.8841, is 
  1.17  amended by adding a subdivision to read: 
  1.18     Subd. 11.  [POWERS; DUTIES; METROPOLITAN COUNCIL SERVICES 
  1.19  AND APPROVALS; OVERSIGHT.] The commission must monitor, review, 
  1.20  and make recommendations to the Metropolitan Council and the 
  1.21  legislature with regard to all cases in which the Metropolitan 
  1.22  Council proposes to deny a local unit of government any of the 
  1.23  services or approvals under its control which are necessary for 
  1.24  the implementation of an approved comprehensive plan. 
  1.25     Sec. 3.  Minnesota Statutes 2002, section 473.246, is 
  1.26  amended to read: 
  2.1      473.246 [COUNCIL'S SUBMISSIONS TO LEGISLATIVE COMMISSION.] 
  2.2      Subdivision 1.  [REQUIRED SUBMISSIONS.] The Metropolitan 
  2.3   Council shall submit to the Legislative Commission on 
  2.4   Metropolitan Government information on: 
  2.5      (1) the council's tax rates and dollar amounts levied for 
  2.6   the current year,; 
  2.7      (2) proposed property tax rates and levies,; 
  2.8      (3) operating and capital budgets,; 
  2.9      (4) work program,; 
  2.10     (5) capital improvement program,; 
  2.11     (6) reports of any instances in which the council has 
  2.12  required a local governmental unit to modify any comprehensive 
  2.13  plan pursuant to section 473.175; 
  2.14     (7) reports of any instances in which the Metropolitan 
  2.15  Council proposes to deny a local governmental unit any of the 
  2.16  services or approvals under its control which are necessary for 
  2.17  the implementation of an approved comprehensive plan; and 
  2.18     (8) any other information requested by the commission, for 
  2.19  review by the legislative commission, as provided in section 
  2.20  3.8841. 
  2.21     Subd. 2.  [DELAY ACTION.] If the Legislative Commission on 
  2.22  Metropolitan Government votes to advise the Metropolitan Council 
  2.23  that an action of the council under subdivision 1, clause (6) or 
  2.24  (7), should not be enforced, the council may not enforce that 
  2.25  action until 30 days after the legislature has convened for its 
  2.26  next annual session.
