  1.1                          A bill for an act 
  1.2             relating to alcoholic beverages; authorizing the 
  1.3             commissioner of public safety to issue on-sale 
  1.4             intoxicating liquor licenses to boats permanently 
  1.5             moored on Lake Superior or the St. Croix river or 
  1.6             Mississippi river; amending Minnesota Statutes 1998, 
  1.7             section 340A.408, subdivision 4; Minnesota Statutes 
  1.8             1999 Supplement, section 340A.404, subdivision 8. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1999 Supplement, section 
  1.11  340A.404, subdivision 8, is amended to read: 
  1.12     Subd. 8.  [LAKE SUPERIOR, ST. CROIX RIVER, AND MISSISSIPPI 
  1.13  RIVER TOUR BOATS.] (a) The commissioner may issue an on-sale 
  1.14  intoxicating liquor license to a person regularly engaged, on an 
  1.15  annual or seasonal basis, in the business of offering tours by 
  1.16  boat on Lake Superior and adjacent bays, the St. Croix river, 
  1.17  and the Mississippi river.  The license shall authorize the sale 
  1.18  of intoxicating liquor between May 1 and November 1 for 
  1.19  consumption on the boat while underway or attached to a dock or 
  1.20  other mooring.  No license may be issued unless each boat used 
  1.21  in the tour business regularly sells meals in the place where 
  1.22  intoxicating liquor is sold. 
  1.23     (b) The commissioner may issue an on-sale intoxicating 
  1.24  liquor license to a boat permanently attached to a dock or other 
  1.25  mooring on Lake Superior and adjacent bays, the St. Croix river, 
  1.26  or the Mississippi river.  The license authorizes sale of 
  1.27  intoxicating liquor year-round.  No license may be issued under 
  2.1   this paragraph unless meals are regularly sold in the place on 
  2.2   the boat where intoxicating liquor is served. 
  2.3      (c) All sales of intoxicating liquor made on a boat while 
  2.4   it is attached to a dock or other mooring are subject to any 
  2.5   restrictions on the sale of liquor prescribed by the governing 
  2.6   body of the city where the boat is attached, or of a county when 
  2.7   it is attached outside a city.  A governing body may prohibit 
  2.8   liquor sales within its jurisdiction but may not require an 
  2.9   additional license, or require a fee or occupation tax, for the 
  2.10  sales. 
  2.11     Sec. 2.  Minnesota Statutes 1998, section 340A.408, 
  2.12  subdivision 4, is amended to read: 
  2.13     Subd. 4.  [LAKE SUPERIOR, ST. CROIX RIVER, AND MISSISSIPPI 
  2.14  RIVER TOUR BOATS; COMMON CARRIERS.] (a) The annual license fee 
  2.15  for licensing of Lake Superior, St. Croix river, and Mississippi 
  2.16  river tour boats under section 340A.404, subdivision 8, shall be 
  2.17  $1,000 for boats licensed under paragraph (a) and $200 for boats 
  2.18  licensed under paragraph (b).  The commissioner shall transmit 
  2.19  one-half of this fee to the governing body of the city that is 
  2.20  the home port of the tour boat or to the county in which the 
  2.21  home port is located if the home port is outside a city. 
  2.22     (b) The annual license fee for common carriers licensed 
  2.23  under section 340A.407 is: 
  2.24     (1) $50 for 3.2 percent malt liquor, and $20 for a 
  2.25  duplicate license; and 
  2.26     (2) $200 for intoxicating liquor, and $20 for a duplicate 
  2.27  license.
