A bill for an act
relating to education; requiring a school district to grant secondary credit for
postsecondary courses outside the school year; appropriating money; amending
Minnesota Statutes 2022, sections 124D.09, subdivision 8; 126C.10, subdivision
2a.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 124D.09, subdivision 8, is amended to read:


Subd. 8.

Limit on participation.

new text begin (a) new text end A pupil who first enrolls in grade 9 may not enroll
in postsecondary courses under this section for secondary credit for more than the equivalent
of four academic years. A pupil who first enrolls in grade 10 may not enroll in postsecondary
courses under this section for secondary credit for more than the equivalent of three academic
years. A pupil who first enrolls in grade 11 may not enroll in postsecondary courses under
this section for secondary credit for more than the equivalent of two academic years. A
pupil who first enrolls in grade 12 may not enroll in postsecondary courses under this section
for secondary credit for more than the equivalent of one academic year. If a pupil in grade
9, 10, 11, or 12 first enrolls in a postsecondary course for secondary credit during the school
year, the time of participation shall be reduced proportionately. If a pupil is in a learning
year or other year-round program and begins each grade in the summer session, summer
sessions shall not be counted against the time of participation. If a school district determines
a pupil is not on track to graduate, the limit on participation does not apply to that pupil. A
pupil who has graduated from high school cannot participate in a program under this section.
A pupil who has completed course requirements for graduation but who has not received a
diploma may participate in the program under this section.

new text begin (b) The limits on participation under paragraph (a) do not apply to a pupil who enrolls
in postsecondary courses under this section outside of the regular school year, unless the
student has graduated from high school before enrolling in the postsecondary course.
Notwithstanding any law to the contrary, a student who enrolls in postsecondary courses
outside of the regular school year generates extended time revenue. A school district must
grant secondary credit to a pupil who completes a postsecondary course outside of the
regular school year.

Sec. 2.

Minnesota Statutes 2022, section 126C.10, subdivision 2a, is amended to read:


Subd. 2a.

Extended time revenue.

(a) A school district's extended time revenue is equal
to the product of $5,117 and the sum of the adjusted pupil units of the district for each pupil
in average daily membership in excess of 1.0 and less than 1.2 according to section 126C.05,
subdivision 8
.

(b) Extended time revenue for pupils placed in an on-site education program at the Prairie
Lakes Education Center or the Lake Park School, located within the borders of Independent
School District No. 347, Willmar, for instruction provided after the end of the preceding
regular school year and before the beginning of the following regular school year equals
membership hours divided by the minimum annual instructional hours in section 126C.05,
subdivision 15, not to exceed 0.20, times the pupil unit weighting in section 126C.05,
subdivision 1, times $5,117.

(c) A school district's extended time revenue may be used for extended day programs,
extended week programs, summer school, vacation break academies such as spring break
academies and summer term academies, and other programming authorized under the
learning year program.
