  1.1                          A bill for an act
  1.2             relating to health; providing an exemption from the 
  1.3             MinnesotaCare program four month uninsured 
  1.4             requirement; modifying MinnesotaCare eligibility 
  1.5             requirements for children who are part-time students; 
  1.6             amending Minnesota Statutes 1997 Supplement, sections 
  1.7             256L.07, subdivision 3; and 256L.13, by adding a 
  1.8             subdivision. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.11  256L.07, subdivision 3, is amended to read: 
  1.12     Subd. 3.  [PERIOD UNINSURED.] To be eligible for subsidized 
  1.13  premium payments based on a sliding scale, families and 
  1.14  individuals initially enrolled in the MinnesotaCare program 
  1.15  under section 256L.04, subdivisions 5 and 7, must have had no 
  1.16  health coverage for at least four months prior to application.  
  1.17  The commissioner may change this eligibility criterion for 
  1.18  sliding scale premiums in order to remain within the limits of 
  1.19  available appropriations.  The requirement of at least four 
  1.20  months of no health coverage prior to application for the 
  1.21  MinnesotaCare program does not apply to: 
  1.22     (1) families, children, and individuals who apply for the 
  1.23  MinnesotaCare program upon termination from or as required by 
  1.24  the medical assistance program, general assistance medical care 
  1.25  program, or coverage under a regional demonstration project for 
  1.26  the uninsured funded under section 256B.73, the Hennepin county 
  1.27  assured care program, or the Group Health, Inc., community 
  2.1   health plan; 
  2.2      (2) families and individuals initially enrolled under 
  2.3   section 256L.04, subdivisions 1, paragraph (a), and 3; 
  2.4      (3) children enrolled pursuant to Laws 1992, chapter 549, 
  2.5   article 4, section 17; or 
  2.6      (4) individuals currently serving or who have served in the 
  2.7   military reserves, and dependents of these individuals, if these 
  2.8   individuals:  (i) reapply for MinnesotaCare coverage after a 
  2.9   period of active military service during which they had been 
  2.10  covered by the Civilian Health and Medical Program of the 
  2.11  Uniformed Services (CHAMPUS); (ii) were covered under 
  2.12  MinnesotaCare immediately prior to obtaining coverage under 
  2.13  CHAMPUS; and (iii) have maintained continuous coverage; or 
  2.14     (5) families, children, and individuals who lose 
  2.15  employer-subsidized coverage for reasons that would not 
  2.16  disqualify an individual for unemployment benefits under section 
  2.17  268.09 and the family, child, or individual has not had access 
  2.18  to employer-subsidized coverage since the loss of coverage. 
  2.19     Sec. 2.  Minnesota Statutes 1997 Supplement, section 
  2.20  256L.13, is amended by adding a subdivision to read: 
  2.21     Subd. 8.  [DETERMINATION OF ELIGIBILITY FOR CHILDREN WHO 
  2.22  ARE PART-TIME STUDENTS.] (a) The commissioner shall determine 
  2.23  eligibility under section 256L.04, subdivision 7, for children 
  2.24  with gross family incomes that exceed the income standard in 
  2.25  subdivision 1 and who are: 
  2.26     (1) age 18 through 21; 
  2.27     (2) students enrolled in at least six but fewer than 12 
  2.28  credits per quarter or semester, or the equivalent; 
  2.29     (3) working at least eight but less than 30 hours per week 
  2.30  on average; and 
  2.31     (4) residing with their parents or legal guardians.  
  2.32     (b) In determining eligibility under section 256L.04, 
  2.33  subdivision 7, the commissioner shall count only the child's 
  2.34  income.  The commissioner shall require proof of school 
  2.35  enrollment and employment.
