A bill for an act
relating to public safety; authorizing cities and counties to impose residency
requirements for peace officers; amending Minnesota Statutes 2020, section 415.16,
by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 415.16, is amended by adding a subdivision
to read:

new text begin Required residency; peace officers. new text end

new text begin (a) Notwithstanding subdivision 1, a
statutory or home rule charter city or county may establish a residency requirement for a
peace officer hired on or after July 1, 2021, as a condition of employment by the city or
county. A residency requirement may include but is not limited to living in the jurisdiction
of the city or county or within a certain distance from the city or county.

new text begin (b) Nothing in paragraph (a) limits the rights of a peace officer, through the officer's
certified exclusive representative, to meet and negotiate in good faith with the employer
regarding grievance procedures, residency incentives under subdivision 1a, and the terms
and conditions of employment.

626.84, subdivision 1, paragraph (c).
