  1.1                          A bill for an act 
  1.2             relating to natural resources; modifying the penalty 
  1.3             for a snowmobile operator fleeing a law enforcement 
  1.4             officer; amending Minnesota Statutes 1994, sections 
  1.5             84.873; and 84.88, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 84.873, is 
  1.8   amended to read: 
  1.9      84.873 [SIGNAL FROM OFFICER TO STOP.] 
  1.10     Subdivision 1.  [PROHIBITED ACTS; MISDEMEANOR.] It is 
  1.11  unlawful for a snowmobile operator, after having received a 
  1.12  visual or audible signal from any law enforcement officer to 
  1.13  come to a stop, to (a) (1) operate a snowmobile in willful or 
  1.14  wanton disregard of such signal, or (b) (2) interfere with or 
  1.15  endanger the law enforcement officer or any other person or 
  1.16  vehicle, or (c) increase speed or attempt to flee or elude the 
  1.17  officer.  
  1.18     Subd. 2.  [PROHIBITED ACT; GROSS MISDEMEANOR.] It is a 
  1.19  violation of section 609.487, subdivision 3, to flee or attempt 
  1.20  to flee by means of a snowmobile from a law enforcement officer 
  1.21  who is acting in the lawful discharge of an official duty, when 
  1.22  the snowmobile operator knows or should reasonably know the same 
  1.23  to be a law enforcement officer. 
  1.24     Subd. 3.  [PROHIBITED ACT; FELONY.] It is a violation of 
  1.25  section 609.487, subdivision 4, to flee or attempt to flee by 
  2.1   means of a snowmobile from a law enforcement officer who is 
  2.2   acting in the lawful discharge of an official duty, when the 
  2.3   snowmobile operator knows or should reasonably know the same to 
  2.4   be a law enforcement officer and when, in the course of fleeing, 
  2.5   the snowmobile operator causes the death of a human being not 
  2.6   constituting murder or manslaughter or causes any bodily injury 
  2.7   to a person other than the snowmobile operator. 
  2.8      Subd. 4.  [ADDITIONAL PENALTIES.] A violation of this 
  2.9   section is also punishable under section 84.88. 
  2.10     Sec. 2.  Minnesota Statutes 1994, section 84.88, 
  2.11  subdivision 1, is amended to read: 
  2.12     Subdivision 1.  Unless a different penalty is prescribed, 
  2.13  any person who shall violate any provision of sections 84.81 to 
  2.14  84.89 or any rule of the commissioner of natural resources or of 
  2.15  the commissioner of public safety promulgated pursuant to law 
  2.16  shall be guilty of a misdemeanor.
