A bill for an act
relating to human services; establishing payment rates for substance use disorder
treatment services with medications for opioid use disorder; proposing coding for
new law in Minnesota Statutes, chapter 254B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

TREATMENT SERVICES WITH MEDICATIONS FOR OPIOID USE DISORDER.

new text begin Notwithstanding sections 254B.03, subdivision 9,
paragraph (a), clause (2); 254B.05, subdivision 5, paragraph (a); and 254B.12, subdivision
1, the commissioner shall use the rates in this section for substance use disorder treatment
services with medications for opioid use disorder under section 254B.05, subdivision 5,
paragraph (b), clause (6).

new text begin Effective each January 1, the commissioner must update the
rates for the services specified in this section to equal the corresponding Minnesota specific
locality adjusted Medicare rates for the same or comparable services in the calendar year
in which the services are provided.

which a payment was made under this section for services provided to an individual, the
subsequent monthly rate for office-based care coordination and at least 60 minutes of
individual therapy, group therapy, or counseling is $383.45.

new text begin The rate for medically necessary presumptive drug
tests to detect the presence or absence of a drug or drug class conducted in conjunction with
office-based substance use disorder treatment services with medications for opioid use
disorder are specified in clauses (1) to (3):

new text begin (1) the rate for a presumptive drug test using a device or procedure capable of being
read by direct optical observation is $12.60 per test;
new text end

new text begin (2) the rate for a presumptive drug test using a device or procedure read by
instrument-assisted direct optical observation is $17.14 per test; and
new text end

new text begin (3) the rate for a presumptive drug test using a chemistry analyzer is $62.14 per test.
