  1.1                          A bill for an act 
  1.2             relating to retirement; Minneapolis teachers 
  1.3             retirement fund association; authorizing the purchase 
  1.4             of service credit by certain special school district 
  1.5             No. 1 (Minneapolis) teachers for periods of teaching 
  1.6             service during which members' contributions were not 
  1.7             deducted; requiring employer payment of a portion of 
  1.8             purchase payment amount. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [MINNEAPOLIS TEACHERS RETIREMENT FUND 
  1.11  ASSOCIATION; PRIOR SERVICE CREDIT PURCHASE AUTHORIZATION.] 
  1.12     (a) Notwithstanding any provision of law to the contrary, a 
  1.13  person described in paragraph (b) is authorized to purchase 
  1.14  allowable service credit from the basic program of the 
  1.15  Minneapolis teachers retirement fund association for the period 
  1.16  described in paragraph (c) by making the payment specified in 
  1.17  paragraph (d). 
  1.18     (b) An eligible person for purposes of paragraph (a) is a 
  1.19  person who: 
  1.20     (1) was born on October 1, 1942; 
  1.21     (2) is currently employed by special school district No. 1 
  1.22  (Minneapolis) and is currently a member of the Minneapolis 
  1.23  teachers retirement fund association; 
  1.24     (3) was initially hired by special school district No. 1 
  1.25  (Minneapolis) on November 13, 1967, and taught at Sanford Junior 
  1.26  High School until June 1968; 
  1.27     (4) was reemployed by special school district No. 1 
  2.1   (Minneapolis) as an adult basic education English and social 
  2.2   studies teacher on May 25, 1970, and continued to teach in that 
  2.3   program until December 17, 1984; and 
  2.4      (5) as a result of binding arbitration of an employment 
  2.5   dispute, was employed by special school district No. 1 
  2.6   (Minneapolis) as an English teacher at Franklin Junior High 
  2.7   School on December 17, 1984. 
  2.8      (c) The service credit purchase period is any period 
  2.9   between May 25, 1970, to December 17, 1984, that has not 
  2.10  previously been credited by the Minneapolis teachers retirement 
  2.11  fund association. 
  2.12     (d) To purchase the allowable service credit, the eligible 
  2.13  person must pay to the Minneapolis teachers retirement fund 
  2.14  association the member contribution that the person would have 
  2.15  made on the compensation paid by the special school district No. 
  2.16  1 (Minneapolis), plus interest at an annual compound interest 
  2.17  rate of 8.5 percent from the date that the contribution would 
  2.18  have been paid until the date that the payment is made. 
  2.19     (e) Following the payment by the eligible person, the 
  2.20  executive director of the Minneapolis teachers retirement fund 
  2.21  association shall certify that fact to the superintendent of 
  2.22  special school district No. 1 (Minneapolis) and, within 60 days 
  2.23  of the receipt of that certification, shall pay the balance of 
  2.24  the prior service credit purchase payment calculated under 
  2.25  Minnesota Statutes, section 356.55, that is not paid under 
  2.26  paragraph (d).  If the school district does not pay this amount 
  2.27  in a timely manner, the executive director of the Minneapolis 
  2.28  teachers retirement fund association shall certify that fact to 
  2.29  the commissioner of finance, who shall deduct the unpaid amount 
  2.30  from any state aid otherwise payable to special school district 
  2.31  No. 1 (Minneapolis). 
  2.32     (f) The eligible person must provide all relevant 
  2.33  documentation of the applicability of the requirements set forth 
  2.34  in paragraph (b) and any other applicable information that the 
  2.35  executive director of the Minneapolis teachers retirement fund 
  2.36  association may request.  
  3.1      (g) This prior service credit purchase authority expires on 
  3.2   July 1, 2001, or on the date of the eligible person's 
  3.3   termination of active service with special school district No. 1 
  3.4   (Minneapolis), whichever is earlier. 
  3.5      Sec. 2.  [EFFECTIVE DATE.] 
  3.6      Section 1 is effective the day following final enactment.
