  1.1                          A bill for an act 
  1.2             relating to data practices; authorizing release of 
  1.3             pawnshop data to members of criminal justice agencies 
  1.4             for specified law enforcement purposes; amending 
  1.5             Minnesota Statutes 1996, section 13.82, subdivision 18.
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 13.82, 
  1.8   subdivision 18, is amended to read: 
  1.9      Subd. 18.  [PAWNSHOP DATA.] (a) Except as provided for in 
  1.10  paragraph (b), data that would reveal the identity of persons 
  1.11  who are customers of a licensed pawnbroker or secondhand goods 
  1.12  dealer are private data on individuals.  Data describing the 
  1.13  property in a regulated transaction with a licensed pawnbroker 
  1.14  or secondhand goods dealer are public. 
  1.15     (b) Data that would reveal the identity of persons who are 
  1.16  customers of a licensed pawnbroker or secondhand goods dealer 
  1.17  shall not be withheld from members of a criminal justice agency 
  1.18  who are:  
  1.19     (1) collecting or creating investigative data in order to 
  1.20  prepare a case against a person, whether known or unknown, for 
  1.21  the commission of a crime or other offense for which the agency 
  1.22  has primary investigative responsibility; or 
  1.23     (2) endeavoring to return stolen property to its rightful 
  1.24  owner. 
  1.25     (c) For purposes of paragraph (b), "customers" means both 
  2.1   sides of a pawn transaction, including the person to whom a loan 
  2.2   was made on the security of pledged goods, as defined in section 
  2.3   325J.01, subdivision 7, and the person purchasing pledged goods.
