  1.1                          A bill for an act 
  1.2             relating to crime prevention; expanding the criminal 
  1.3             penalty for fleeing a peace officer to include the 
  1.4             forfeiture of motor vehicles used in the offense; 
  1.5             providing a penalty; amending Minnesota Statutes 1994, 
  1.6             section 609.487, by adding a subdivision; repealing 
  1.7             Minnesota Statutes 1995 Supplement, section 609.5312, 
  1.8             subdivision 4. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 609.487, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 5.  [CRIMINAL FORFEITURE.] (a) When a person is 
  1.13  convicted of violating this section, the court may order the 
  1.14  person to forfeit to the prosecuting authority the motor vehicle 
  1.15  used in the violation.  Forfeiture may be ordered in addition 
  1.16  to, or as an alternative to, other penalties provided for in 
  1.17  this section. 
  1.18     (b) A forfeiture under this subdivision is governed by 
  1.19  sections 609.907 and 609.908. 
  1.20     (c) A vehicle leased or rented under section 168.27, 
  1.21  subdivision 4, for a period of 180 days or less is not subject 
  1.22  to forfeiture under this subdivision. 
  1.23     Sec. 2.  [REPEALER.] 
  1.24     Minnesota Statutes 1995 Supplement, section 609.5312, 
  1.25  subdivision 4, is repealed.
