  1.1                          A bill for an act 
  1.2             relating to education; requiring school facility 
  1.3             commissioning cost information to be included in the 
  1.4             review and comment process; amending Minnesota 
  1.5             Statutes 1998, section 123B.71, subdivision 10; 
  1.6             Minnesota Statutes 1999 Supplement, section 126C.23, 
  1.7             by adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 123B.71, 
  1.10  subdivision 10, is amended to read: 
  1.11     Subd. 10.  [INDOOR AIR QUALITY.] A school board seeking a 
  1.12  review and comment under this section must submit information 
  1.13  demonstrating to the commissioner's satisfaction that: 
  1.14     (1) indoor air quality issues have been considered; and 
  1.15     (2) the costs of commissioning the facility under section 
  1.16  123B.72 have been included in the overall facility costs; and 
  1.17     (3) the architects and engineers designing the facility 
  1.18  will have professional liability insurance. 
  1.19     Sec. 2.  Minnesota Statutes 1999 Supplement, section 
  1.20  126C.23, is amended by adding a subdivision to read: 
  1.21     Subd. 3a.  [FACILITIES.] A school district must not 
  1.22  reallocate any revenue attributable to school facilities unless 
  1.23  the board of the district has determined that the building is 
  1.24  without deferred maintenance needs. 
  1.25     Sec. 3.  [EFFECTIVE DATE.] 
  1.26     Section 1 is effective for school facility review and 
  2.1   comments submitted to the commissioner of children, families, 
  2.2   and learning on or after July 1, 2000.
