  1.1                          A bill for an act 
  1.2             relating to occupations; permitting sprinkler system 
  1.3             maintenance by licensed plumbers; providing that 
  1.4             certain minor plumbing repairs need not be performed 
  1.5             by licensed plumbers; amending Minnesota Statutes 
  1.6             1994, sections 299M.03, as amended; and 326.40, 
  1.7             subdivision 1. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 299M.03, as 
  1.10  amended by Laws 1995, chapter 265, article 2, section 27, is 
  1.11  amended to read: 
  1.12     299M.03 [LICENSE OR CERTIFICATE REQUIRED.] 
  1.13     Subdivision 1.  [CONTRACTOR LICENSE.] A person may not 
  1.14  sell, design, install, modify, or inspect a fire protection 
  1.15  system, its parts, or related equipment, or offer to do so, 
  1.16  unless annually licensed to perform these duties as a fire 
  1.17  protection contractor.  No license is required under this 
  1.18  section for: 
  1.19     (1) a person licensed as a professional engineer under 
  1.20  section 326.03 who is competent in fire protection system design 
  1.21  or; 
  1.22     (2) a person licensed as an alarm and communication 
  1.23  contractor under section 326.2421 for performing activities 
  1.24  authorized by that license; or 
  1.25     (3) a licensed plumber performing basic maintenance of 
  1.26  sprinkler systems.  
  2.1      Subd. 2.  [JOURNEYMAN CERTIFICATE.] A person may not 
  2.2   install, connect, alter, repair, or add to a fire protection 
  2.3   system, under the supervision of a fire protection contractor, 
  2.4   unless annually certified to perform those duties as a 
  2.5   journeyman sprinkler fitter or as a registered apprentice 
  2.6   sprinkler fitter.  This subdivision does not apply to: 
  2.7      (1) a person altering or repairing a fire protection system 
  2.8   if the system uses low pressure water and the system is located 
  2.9   in a facility regulated under the federal Mine Occupational 
  2.10  Safety and Health Act; or 
  2.11     (2) a licensed plumber performing basic maintenance of 
  2.12  sprinkler systems. 
  2.13     Sec. 2.  Minnesota Statutes 1994, section 326.40, 
  2.14  subdivision 1, is amended to read: 
  2.15     Subdivision 1.  [PLUMBERS MUST BE LICENSED IN CERTAIN 
  2.16  CITIES; MASTER AND JOURNEYMAN PLUMBERS; PLUMBING ON ONE'S OWN 
  2.17  PREMISES; RULES FOR EXAMINATION.] (a) In any city now or 
  2.18  hereafter having 5,000 or more population, according to the last 
  2.19  federal census, and having a system of waterworks or sewerage, 
  2.20  no person, firm, or corporation shall engage in or work at the 
  2.21  business of a master plumber or journeyman plumber unless 
  2.22  licensed to do so by the state commissioner of health.  A master 
  2.23  plumber may also work as a journeyman plumber.  Anyone not so 
  2.24  licensed may do plumbing work which: 
  2.25     (1) complies with the provisions of the minimum standard 
  2.26  prescribed by the state commissioner of health on premises or 
  2.27  that part of premises owned and actually occupied by the worker 
  2.28  as a residence, unless otherwise forbidden to do so by a local 
  2.29  ordinance; or 
  2.30     (2) consists of general repair of piping, plumbing 
  2.31  fixtures, and appurtenances, provided that material is replaced 
  2.32  with like material and no changes or modifications to the system 
  2.33  are made. 
  2.34     (b) In any such city described in paragraph (a), no person, 
  2.35  firm, or corporation shall engage in the business of installing 
  2.36  plumbing nor install plumbing in connection with the dealing in 
  3.1   and selling of plumbing material and supplies unless at all 
  3.2   times a licensed master plumber, who shall be responsible for 
  3.3   proper installation, is in charge of the plumbing work of the 
  3.4   person, firm, or corporation. 
  3.5      (c) The department of health shall prescribe rules, not 
  3.6   inconsistent herewith, for the examination and licensing of 
  3.7   plumbers.
