  1.1                          A bill for an act 
  1.2             relating to public safety; providing for creation of a 
  1.3             propane council. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [PROPANE ASSESSMENT.] 
  1.6      Businesses involved in producing, transporting, or selling 
  1.7   propane, and in manufacturing or distributing propane 
  1.8   utilization equipment may create a council to impose an 
  1.9   assessment of up to five mills per gallon of odorized propane to 
  1.10  fund propane education and research activities.  The assessment 
  1.11  must be imposed at the time of odorization or import of odorized 
  1.12  propane. 
  1.13     Sec. 2.  [PRICING.] 
  1.14     In all cases, the price of propane must be determined by 
  1.15  market forces.  Consistent with the antitrust law, the council 
  1.16  shall take no action, nor may any provision of this act be 
  1.17  interpreted as, establishing an agreement to pass along to 
  1.18  consumers the cost of the assessment provided for in section 1. 
  1.19     Sec. 3.  [RELATION TO OTHER LAWS.] 
  1.20     (a) Nothing in this act may be construed to preempt or 
  1.21  supersede any other program relating to propane education and 
  1.22  research organized and operated under the laws of the state of 
  1.23  Minnesota. 
  1.24     (b) Minnesota Statutes, section 15.059, does not apply to 
  2.1   this act. 
  2.2      Sec. 4.  [INSTRUCTION TO REVISOR.] 
  2.3      (a) If a council is approved and organized pursuant to 
  2.4   section 1, the council shall notify the revisor of statutes of 
  2.5   that fact in writing. 
  2.6      (b) On receiving notice under paragraph (a), the revisor 
  2.7   shall codify this act in the next edition of Minnesota Statutes 
  2.8   or Minnesota Statutes Supplement, as applicable. 
  2.9      (c) The commissioner of public safety must notify the 
  2.10  revisor of statutes if the council is terminated.  Sections 1 to 
  2.11  3 are repealed if the council is terminated.
