  1.1                          A bill for an act 
  1.2             relating to the environment; making noise pollution 
  1.3             mitigation eligible for contamination cleanup grants; 
  1.4             amending Minnesota Statutes 2002, section 116J.552, 
  1.5             subdivision 3; by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 116J.552, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [CONTAMINANT.] "Contaminant" means a hazardous 
  1.10  substance or a pollutant or contaminant as those terms are 
  1.11  defined in section 115B.02.  Contaminant also includes noise 
  1.12  pollution. 
  1.13     Sec. 2.  Minnesota Statutes 2002, section 116J.552, is 
  1.14  amended by adding a subdivision to read: 
  1.15     Subd. 6a.  [NOISE POLLUTION.] "Noise pollution" means the 
  1.16  presence of any noise or combination of noise, including low 
  1.17  frequency noise, in such quantity, at such levels, of such 
  1.18  nature and duration, or under such conditions that it is 
  1.19  injurious to human health or welfare, including but not limited 
  1.20  to psychological health or welfare, or to property, or 
  1.21  interferes unreasonably with the enjoyment of life or property.
