A bill for an act
relating to crime; making it a felony to intentionally stop a beating heart;
proposing coding for new law in Minnesota Statutes, chapter 609.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) Whoever intentionally and permanently causes the heart of a human being to
stop beating is guilty of a felony and may be sentenced to imprisonment for not more than
15 years or to payment of a fine of not more than $30,000, or both.

new text begin (b) As used in this section, "human being" has the meaning provided in section
145.423, subdivision 4.

new text begin (c) Paragraph (a) does not apply to licensed health professionals who perform
medical procedures intended to treat a diagnosed medical condition or to save the life of
the person on whom the medical procedure is performed.

new text begin (d) Paragraph (a) does not apply to health care provided according to a living will
executed under chapter 145B, a health care directive executed under chapter 145C, or to a
properly executed do-not-resuscitate order.
