  1.1                          A bill for an act 
  1.2             relating to crimes; providing that certain records 
  1.3             relating to driving while impaired must be destroyed 
  1.4             after seven years; making clarifying changes; amending 
  1.5             Minnesota Statutes 2002, section 171.12, subdivision 3.
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 171.12, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [APPLICATION AND RECORD, WHEN DESTROYED.] The 
  1.10  department may cause applications for drivers' licenses, 
  1.11  provisional licenses, and instruction permits, and related 
  1.12  records, to be destroyed immediately after the period for which 
  1.13  issued, except that: 
  1.14     (1) the driver's record pertaining to revocations, 
  1.15  suspensions, cancellations, disqualifications, convictions, and 
  1.16  accidents shall be are cumulative and must be kept for a period 
  1.17  of at least five years; and 
  1.18     (2) the driver's record pertaining to the alcohol-related 
  1.19  offenses and licensing actions listed in section 169A.03, 
  1.20  subdivisions 20 and 21, and to violations of sections 169A.31 
  1.21  and 171.24, subdivision 5, shall be are cumulative and must be 
  1.22  kept for a period of at least 15 years, except as provided in 
  1.23  clause (3); and 
  1.24     (3) the driver's record pertaining to the alcohol-related 
  1.25  offenses and licensing actions listed in section 169A.03, 
  2.1   subdivisions 20 and 21, and to violations of section 169A.31 
  2.2   must be purged after seven years of any reference to an offense 
  2.3   or action if the driver has incurred no other alcohol-related 
  2.4   offenses or licensing actions under those sections during the 
  2.5   seven-year period. 
  2.6      [EFFECTIVE DATE.] This section is effective July 1, 2004.
