A bill for an act
relating to state lottery; restricting delivery methods; modifying restrictions;
amending Minnesota Statutes 2012, section 349A.13; proposing coding for new
law in Minnesota Statutes, chapter 349A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 349A.13, is amended to read:


349A.13 RESTRICTIONS.

Nothing in this chapter:

(1) authorizes the director to conduct a lottery game or contest the winner or winners
of which are determined by the result of a sporting event other than a horse race conducted
under chapter 240;

(2) authorizes the director to install or operate a lottery device operated by coin or
currency which when operated determines the winner of a game; and

(3) authorizes the director to sell pull-tabs as defined under section 349.12,
subdivision 32

(4) authorizes the director to sell electronic scratch-off or similar lottery tickets over
the Internet, in which the winner is determined instantly. This does not prohibit the sale
of electronic tickets for a specific drawing of a lottery game where a drawing of random
letters or numbers will determine a winner;

(5) authorizes the director to sell or dispense scratch-off tickets or draw tickets from
an automated teller machine; and

(6) authorizes the director to study, test, sell, or use a game or delivery method not
authorized in section 349A.17
.

EFFECTIVE DATE.

This section is effective the day following final enactment.

Sec. 2.

[349A.17] DELIVERY METHODS.

Subdivision 1.

Scratch-off tickets.

The director may offer for sale scratch-off
lottery tickets in either of the following ways:

(1) for sale inside a retailer's premises who holds a valid retailer contract under
this chapter; and

(2) from an automated dispensing machine.

Subd. 2.

Drawing tickets.

The director may offer for sale tickets for a lottery
drawing where the winner is determined through the random drawing of a combination of
letters or numbers in either of the following ways:

(1) for sale inside a retailer's premises who hold a valid retailer contract under
this chapter; and

(2) for sale on a Web site operated by the Minnesota State Lottery.

EFFECTIVE DATE.

This section is effective the day following final enactment.
