  1.1                          A bill for an act 
  1.2             relating to state government; creating the department 
  1.3             of game and fish; transferring certain 
  1.4             responsibilities of the commissioner of natural 
  1.5             resources to the commissioner of game and fish; 
  1.6             amending Minnesota Statutes 1998, section 15.01; 
  1.7             proposing coding for new law in Minnesota Statutes, 
  1.8             chapter 97A. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 15.01, is 
  1.11  amended to read: 
  1.12     15.01 [DEPARTMENTS OF THE STATE.] 
  1.13     The following agencies are designated as the departments of 
  1.14  the state government:  the department of administration; the 
  1.15  department of agriculture; the department of commerce; the 
  1.16  department of corrections; the department of children, families, 
  1.17  and learning; the department of economic security; the 
  1.18  department of trade and economic development; the department of 
  1.19  finance; the department of game and fish; the department of 
  1.20  health; the department of human rights; the department of labor 
  1.21  and industry; the department of military affairs; the department 
  1.22  of natural resources; the department of employee relations; the 
  1.23  department of public safety; the department of public service; 
  1.24  the department of human services; the department of revenue; the 
  1.25  department of transportation; the department of veterans 
  1.26  affairs; and their successor departments. 
  1.27     Sec. 2.  [97A.02] [DEPARTMENT OF GAME AND FISH, 
  2.1   COMMISSIONER'S DUTIES.] 
  2.2      Subdivision 1.  [DEPARTMENT CREATED.] The department of 
  2.3   game and fish is created.  The commissioner of game and fish 
  2.4   shall manage the department and shall be appointed by the 
  2.5   governor under section 15.06. 
  2.6      Subd. 2.  [COMMISSIONER'S DUTIES.] The commissioner shall 
  2.7   have all charge and control of the taking of wild animals. 
  2.8      Subd. 3.  [RULEMAKING AUTHORITY.] Subject to chapter 14, 
  2.9   the commissioner may adopt, amend, and repeal rules relating to 
  2.10  any purpose, responsibility, or authorization in this chapter 
  2.11  and chapters 97B and 97C.  Rules adopted must comply with the 
  2.12  provisions of this chapter and chapters 97B and 97C that specify 
  2.13  or restrict the adoption of particular rules. 
  2.14     Sec. 3.  [TRANSFER OF RESPONSIBILITIES.] 
  2.15     The responsibilities of the commissioner of natural 
  2.16  resources relating to the taking of wild animals are transferred 
  2.17  to the commissioner of game and fish according to Minnesota 
  2.18  Statutes, section 15.039. 
  2.19     Sec. 4.  [CONFORMING CHANGES.] 
  2.20     The revisor of statutes shall prepare a bill for 
  2.21  introduction to the legislature by January 20, 2000, making 
  2.22  conforming changes in accordance with sections 1 to 5. 
  2.23     Sec. 5.  [REVISOR'S INSTRUCTION.] 
  2.24     The revisor of statutes shall change the phrase "department 
  2.25  of natural resources" to "department of game and fish" and the 
  2.26  phrase "commissioner of natural resources" to "commissioner of 
  2.27  game and fish" wherever the phrases appear in Minnesota 
  2.28  Statutes, chapters 97A, 97B, and 97C.
