A bill for an act
relating to public safety; allowing certain defendants to appear by interactive video
teleconferencing; proposing coding for new law in Minnesota Statutes, chapter
629.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin A person arrested on a warrant issued under section 629.41
shall be informed of the right to demand appearance by interactive video teleconferencing
when:

new text begin (1) the arrest takes place in a county other than the one in which the warrant was issued;
new text end

new text begin (2) the warrant directs that the person be held in custody or the person is unable to meet
the conditions of release;
new text end

new text begin (3) the highest charged offense is a misdemeanor or gross misdemeanor; and
new text end

new text begin (4) the person would otherwise be transported over 50 miles.

new text begin Demand for interactive video teleconferencing. new text end

new text begin On demand, a defendant
meeting the requirements of subdivision 1 shall be permitted to appear by interactive video
teleconferencing for any of the following proceedings:

new text begin (1) hearings conducted pursuant to rule 5, 6, or 8 of the Rules of Criminal Procedure;
new text end

new text begin (2) waiving an omnibus hearing described in rule 11 of the Rules of Criminal Procedure;
new text end

new text begin (3) plea hearings;
new text end

new text begin (4) sentencing hearings;
new text end

new text begin (5) probation revocation hearings; and
new text end

new text begin (6) any hearing for which the defendant's personal presence is not required under rules
14.02, subdivision 2, and 26.03, subdivision 1(3) of the Rules of Criminal Procedure.
