  1.1                          A bill for an act 
  1.2             relating to highways; allowing 24-hour advance 
  1.3             placement of auction signs on or adjacent to highway 
  1.4             right-of-way; amending Minnesota Statutes 1994, 
  1.5             section 169.07. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 169.07, is 
  1.8   amended to read: 
  1.9      169.07 [UNAUTHORIZED SIGNS.] 
  1.10     No person shall place, maintain, or display upon or in view 
  1.11  of any highway any unauthorized sign, signal, marking, or device 
  1.12  which purports to be or is an imitation of or resembles an 
  1.13  official traffic-control device or railroad sign or signal, or 
  1.14  which attempts to direct the movement of traffic, or which hides 
  1.15  from view or interferes with the effectiveness of any official 
  1.16  traffic-control device or any railroad sign or signal, and no 
  1.17  person shall place or maintain, nor shall any public authority 
  1.18  permit, upon any highway any traffic sign or signal bearing 
  1.19  thereon any commercial advertising.  This shall not be deemed to 
  1.20  prohibit (1) the erection upon private property adjacent to 
  1.21  highways of signs giving useful directional information and of a 
  1.22  type that cannot be mistaken for official signs, or (2) the 
  1.23  temporary placement by auctioneers licensed or exempt from 
  1.24  licensing under section 330.01, for a period of not more than 
  1.25  eight 24 consecutive hours, on or adjacent to the right-of-way 
  2.1   of a highway not more than four signs directing motorists to the 
  2.2   location of an auction.  The signs must conform to standards for 
  2.3   size, content, placement, and location for such signs 
  2.4   promulgated by the commissioner of transportation.  The rules 
  2.5   may require a permit for each such sign but no fee may be 
  2.6   charged for the permit.  
  2.7      Every such prohibited sign, signal, or marking is hereby 
  2.8   declared to be a public nuisance, and the authority having 
  2.9   jurisdiction over the highways is hereby empowered to remove the 
  2.10  same, or cause it to be removed, without notice. 
  2.11     Sec. 2.  [EFFECTIVE DATE.] 
  2.12     Section 1 is effective the day following final enactment.
