  1.1                          A bill for an act
  1.2             relating to crime prevention; imposing lifetime 
  1.3             conditional release on sex offenders who fail to 
  1.4             register as predatory offenders; amending Minnesota 
  1.5             Statutes 2002, section 243.166, by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 243.166, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 5a.  [CONDITIONAL RELEASE.] (a) Notwithstanding the 
  1.11  statutory maximum sentence otherwise applicable to the offense 
  1.12  or any provision of the sentencing guidelines, when a court 
  1.13  convicts a person who is a level III sex offender under section 
  1.14  244.052, subdivision 3, paragraph (e), for a violation of 
  1.15  subdivision 5, the court shall provide that after the person has 
  1.16  completed the sentence imposed, the commissioner of corrections 
  1.17  shall place the person on conditional release for the remainder 
  1.18  of the person's life. 
  1.19     (b) The conditions of release may include satisfaction of 
  1.20  the release conditions specified in section 244.05, subdivision 
  1.21  6, and any other conditions the commissioner considers 
  1.22  appropriate.  If the offender fails to meet any condition of 
  1.23  release, the commissioner may revoke the offender's conditional 
  1.24  release and order that the offender serve the remaining portion 
  1.25  of the conditional release term in prison. 
  1.26     Conditional release under this subdivision is governed by 
  2.1   provisions relating to supervised release, except as otherwise 
  2.2   provided in this subdivision or section 244.05. 
  2.3      [EFFECTIVE DATE.] This section is effective August 1, 2004, 
  2.4   and applies to crimes committed on or after that date.
