relating to human services finance; restoring certain hospital payment
unallotments; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) Notwithstanding the requirements of Minnesota Statutes, section 16A.152,
subdivision 2, if on the basis of a forecast of general fund revenues and expenditures, the
commissioner of finance determines that there will be a positive unrestricted budgetary
general fund balance at the close of the biennium ending June 30, 2009, the commissioner
must allocate the amount necessary, not to exceed $38,000,000, to restore the hospital
payment reductions due to unallotments by the governor in fiscal year 2009 of medical
education and research fund payments and disproportionate share hospital payments.

new text begin (b) The allocation under paragraph (a) shall occur prior to the allocations in
Minnesota Statutes, section 16A.152, subdivision 2. The amounts necessary to meet the
requirements of this section are appropriated from the general fund to the commissioners
of human services and of health to restore the hospital payments.
