A bill for an act
 relating to the Duluth Seaway Port Authority; modifying the relation of the city
and the port authority; amending Minnesota Statutes 2008, section 469.074, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 469.074, is amended by adding a
subdivision to read:

new text begin Limitation of powers. new text end

new text begin Notwithstanding section 469.053, the city of
Duluth may by resolution impose the following limitations upon the actions of the Seaway
Port Authority of Duluth:

new text begin (1) that the port authority must follow the budget process as provided by the city
and as implemented by the city council and mayor; and
 new text end

new text begin (2) that the city approve the levy for the benefit of the port authority.

new text begin This section is effective the day after the governing body of
the city of Duluth and its chief clerical officer comply with Minnesota Statutes, section
645.021, subdivisions 2 and 3.
