A bill for an act
relating to state government; providing eligibility for an early retirement
incentive in specified circumstances; proposing coding for new law in Minnesota
Statutes, chapter 43A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

EMPLOYEES.

new text begin If a collective bargaining agreement or compensation plan provides an early
retirement incentive to an employee who is a member of the correctional employee
retirement plan, and if eligibility for the incentive is conditioned on the employee
terminating employment during a time period when the employee first attains a certain
age, an employee who first becomes a member of the correctional employee retirement
plan after attaining that age is eligible for the early retirement incentive if the employee
terminates employment within 90 days after becoming a member of the correctional
employee retirement plan.

new text begin Section 1 is effective the day following final enactment. A person who first became
a member of the correctional employees retirement plan as a result of legislation enacted
in 2006, and who had previously attained the age specified in a collective bargaining
agreement or compensation plan as the time period during which an employee must retire
to qualify for an early retirement incentive, must receive the incentive if the employee
retires within 90 days after the effective date of this section.
