A bill for an act
relating to agriculture; allowing the expiration of a metropolitan agricultural
preserve under certain conditions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin METROPOLITAN AGRICULTURAL PRESERVE; EXPIRATION
UNDER CERTAIN CONDITIONS.

new text begin Notwithstanding the eight-year requirement in Minnesota Statutes, section 473H.08,
subdivision 2, the authority with jurisdiction over the land may allow the expiration of
an agricultural preserve, established under Minnesota Statutes, chapter 473H, at least six
years after notification, if:

new text begin (1) the landowner requested the expiration on February 27, 2001; and
new text end

new text begin (2) the landowner agrees to covenanting at least 25 percent of the land to agricultural
use, including aquaculture, for at least ten years after expiration. This restrictive covenant
is binding on the owner or the owner's successor or assignee, and runs with the land.
