A bill for an act
relating to retirement; public employees police and fire plan; extending the disability
benefit application deadline for certain city of Minneapolis police officers.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PERA-P&F; DISABILITY BENEFIT APPLICATION DEADLINE
EXTENSION FOR CERTAIN CITY OF MINNEAPOLIS POLICE OFFICERS.

new text begin (a) Notwithstanding any provisions of Minnesota Statutes, section 353.031 or 353.656,
to the contrary, an eligible person described in paragraph (b) is authorized to file an
application for a disability benefit from the public employees police and fire retirement
plan.

new text begin (b) An eligible person is a person who:
new text end

new text begin (1) was born on March 15, 1972;
new text end

new text begin (2) was initially employed as a police officer by the city of Minneapolis on March 25,
1996;
new text end

new text begin (3) was a member of the public employees police and fire retirement plan;
new text end

new text begin (4) resigned from the city of Minneapolis police department on June 24, 2014; and
new text end

new text begin (5) failed to apply for a duty-related disability benefit within the required 18-month time
period following termination of covered employment.

new text begin (c) If the eligible person files a disability benefit application, they must file the application
and submit evidence, within 60 days of the effective date of this section, to the executive
director of the Public Employees Retirement Association demonstrating that at the time of
termination of service that person would have been entitled to receive a duty disability
benefit under Minnesota Statutes, section 353.656, if the person had applied for that benefit.

new text begin (d) If the Public Employees Retirement Association determines that the eligible person
is entitled to receive a duty disability benefit under Minnesota Statutes, section 353.656,
the eligible person is entitled to retroactive benefit payments from June 24, 2014.
