  1.1                          A bill for an act 
  1.2             relating to the metropolitan airports commission; 
  1.3             clarifying and extending noise mitigation spending 
  1.4             requirements; requiring a report; amending Minnesota 
  1.5             Statutes 1994, section 473.661, subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 473.661, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [NOISE MITIGATION.] (a) According to the schedule 
  1.10  in paragraph (b), commission funds must be dedicated (1) to 
  1.11  supplement the implementation of corrective land use management 
  1.12  measures approved by the Federal Aviation Administration as part 
  1.13  of the commission's Federal Aviation Regulations, part 150 noise 
  1.14  compatibility program, and (2) for soundproofing and 
  1.15  accompanying air conditioning of residences, schools, and other 
  1.16  public buildings when there is a demonstrated need because of 
  1.17  aircraft noise, regardless of the location of the building to be 
  1.18  soundproofed, or any combination of the three. 
  1.19     (b) The noise mitigation program described in paragraph (a) 
  1.20  shall be funded by the commission from whatever source of funds 
  1.21  according to the following schedule: 
  1.22     In 1993, an amount equal to 20 percent of the passenger 
  1.23  facilities charges revenue amount budgeted by the commission for 
  1.24  1993; 
  1.25     In 1994, an amount equal to 20 percent of the passenger 
  2.1   facilities charges revenue amount budgeted by the commission for 
  2.2   1994; 
  2.3      In 1995, an amount equal to 35 percent of the passenger 
  2.4   facilities charges revenue amount budgeted by the commission for 
  2.5   1995; and 
  2.6      In 1996 and 1997, an amount equal to 40 percent of the 
  2.7   passenger facilities charges revenue amount budgeted by the 
  2.8   commission for 1996. 
  2.9      (c) The commission's capital improvement projects, program, 
  2.10  and plan must reflect the requirements of this section.  As part 
  2.11  of the commission's report to the legislature under section 
  2.12  473.621, subdivision 1a, the commission must provide a 
  2.13  description and the status of each noise mitigation project 
  2.14  implemented under this section. 
  2.15     (d) Within 60 180 days of submitting the commission's and 
  2.16  the metropolitan council's report and recommendations on major 
  2.17  airport planning to the legislature as required by section 
  2.18  473.618, the commission, with the assistance of its sound 
  2.19  abatement advisory committee, shall make a recommendation to the 
  2.20  legislature regarding appropriate funding levels for noise 
  2.21  mitigation at Minneapolis-St. Paul International Airport and in 
  2.22  the neighboring communities. 
  2.23     Sec. 2.  [APPLICATION.] 
  2.24     Section 1 applies in the counties of Anoka, Carver, Dakota, 
  2.25  Hennepin, Ramsey, Scott, and Washington.
