  1.1                          A bill for an act
  1.2             relating to veterans; eliminating certain duties of 
  1.3             the board of directors of the Minnesota veterans 
  1.4             homes; amending Minnesota Statutes 1994, section 
  1.5             198.003, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 198.003, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [POLICY; RULES; REPORT.] It is the duty of 
  1.10  the board and The board has the power to: 
  1.11     (1) shall determine policy and, subject to chapter 14, 
  1.12  adopt, amend, and repeal rules for the governance of the homes, 
  1.13  and to adopt emergency rules necessary to implement this 
  1.14  chapter.  With respect to residents' administrative appeal time 
  1.15  periods that are not established by statute, the board may 
  1.16  create by rule reasonable time periods within which a resident 
  1.17  must appeal an administrative determination to the next 
  1.18  administrative level.  If the determination is not appealed 
  1.19  within the time set by rule, the determination becomes final;. 
  1.20     (2) report quarterly to the governor on the management, 
  1.21  operations, and quality of care provided at the homes; and 
  1.22     (3)  The board shall take other action as provided by law. 
  1.23  Emergency rules adopted under this section are not effective 
  1.24  after December 31, 1989.
