  1.1                          A bill for an act 
  1.2             relating to insurance; modifying standards for 
  1.3             participation in the assigned claims plan; amending 
  1.4             Minnesota Statutes 1994, section 65B.64, subdivision 3.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 65B.64, 
  1.7   subdivision 3, is amended to read: 
  1.8      Subd. 3.  A person shall not be entitled to basic economic 
  1.9   loss benefits through the assigned claims plan with respect to 
  1.10  injury which was sustained if at the time of such injury the 
  1.11  injured person was the owner of a private passenger motor 
  1.12  vehicle for which security is required under sections 65B.41 to 
  1.13  65B.71 and that person failed to have such security in effect. 
  1.14     For purposes of determining whether security is required 
  1.15  under section 65B.48, an owner of any vehicle is deemed to have 
  1.16  contemplated the operation or use of the vehicle at all times 
  1.17  unless the owner demonstrates to the contrary by clear and 
  1.18  convincing objective evidence. 
  1.19     Persons, whether or not related by blood or marriage, who 
  1.20  dwell and function together with the owner as a family, other 
  1.21  than adults who have been adjudicated as incompetent and minor 
  1.22  children, shall also be disqualified from benefits through the 
  1.23  assigned claims plan. 
  1.24     Sec. 2.  [EFFECTIVE DATE.] 
  1.25     This act is effective the day following final enactment.
