  1.1                          A bill for an act 
  1.2             relating to metropolitan agricultural preserves; 
  1.3             permitting early termination of a preserve upon the 
  1.4             death of an owner and petition of the heirs or 
  1.5             assigns; amending Minnesota Statutes 2000, section 
  1.6             473H.09. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 473H.09, is 
  1.9   amended to read: 
  1.10     473H.09 [EARLY TERMINATION.] 
  1.11     Termination of an agricultural preserve earlier than a date 
  1.12  derived through application of section 473H.08 may be permitted 
  1.13  only by the governor:  (1) in the event of a public emergency 
  1.14  upon petition from the owner or authority to the governor, or 
  1.15  (2) in the event of the death of the owner, upon petition from 
  1.16  the owner's heirs or assigns.  Termination under this section 
  1.17  must be by executive order.  The determination of a public 
  1.18  emergency shall be by the governor through executive order 
  1.19  pursuant to sections 4.035 and 12.01 to 12.46.  The executive 
  1.20  order shall identify the preserve, the reasons requiring the 
  1.21  action and the date of termination. 
  1.22     Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  1.23     (a) Section 1 is effective the day after its final 
  1.24  enactment. 
  1.25     (b) This act applies in the counties of Anoka, Carver, 
  1.26  Dakota, Hennepin, Ramsey, Scott, and Washington.
