A bill for an act
relating to agriculture; modifying the definition of industrial hemp Next ; establishing
criteria for Previous hemp Next labeled as Minnesota grown; amending Minnesota Statutes 2018,
sections 17.102, subdivision 1; 18K.02, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 17.102, subdivision 1, is amended to read:


Subdivision 1.

Establishment and use of label.

(a) The commissioner shall establish
a "Minnesota grown" logo or labeling statement for use in identifying agricultural products
that are grown, raised, processed, or manufactured in this state. The commissioner may
develop labeling statements that apply to specific marketing or promotional needs. One
version of a labeling statement must identify food products certified as organically grown
in this state. new text begin Except as provided in paragraph (c), new text end the Minnesota grown logo or labeling
statement may be used on products only if 80 percent or more of the agricultural product
is produced in this state.

(b) The Minnesota grown logo or labeling statement may not be used without a license
from the commissioner except that wholesalers and retailers may use the Minnesota grown
logo and labeling statement for displaying and advertising products that qualify for use of
the Minnesota grown logo or labeling statement.

as defined in section 18K.02, subdivision 3, only if 100 percent of the industrial Previous hemp Next was
produced in Minnesota by a person licensed by the commissioner under chapter 18K.

Sec. 2.

Minnesota Statutes 2018, section 18K.02, subdivision 3, is amended to read:


Subd. 3.

Industrial Previous hemp Next .

"Industrial Previous hemp Next " means deleted text begin the plantdeleted text end new text begin any plant species of the
genus
new text end Cannabis deleted text begin sativa L.deleted text end and any deleted text begin partdeleted text end new text begin parts new text end of the plant, whether growing or not, new text begin including
the plant's seeds, and all the plant's derivatives, extracts, cannabinoids, isomers, acids, salts,
and salts of isomers, whether growing or not,

concentration of not more than 0.3 percent on a dry weight basis. Industrial Previous hemp is not
marijuana as defined in section 152.01, subdivision 9.
