  1.1                          A bill for an act 
  1.2             relating to state government; limiting the salaries of 
  1.3             certain legislative employees; amending Minnesota 
  1.4             Statutes 1994, section 43A.18, subdivision 6. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 43A.18, 
  1.7   subdivision 6, is amended to read: 
  1.8      Subd. 6.  [LEGISLATIVE AND JUDICIAL BRANCH COMPENSATION.] 
  1.9   (a) Total compensation plans for unclassified employees of the 
  1.10  legislature and of legislative commissions shall be determined 
  1.11  by the legislature consistent with chapter 3, provided that 
  1.12  insurance benefits for these employees and for legislators shall 
  1.13  be determined by the legislative coordinating commission, 
  1.14  consistent with sections 43A.22 to 43A.30.  The salary of an 
  1.15  unclassified employee of the legislature or of a legislative 
  1.16  commission may not exceed the upper salary limit of the middle 
  1.17  salary range for agency heads as provided by section 15A.081, 
  1.18  subdivision 1.  However, if the salary of an unclassified 
  1.19  employee of the legislature or of a legislative commission 
  1.20  exceeds the upper limit in the middle salary range for agency 
  1.21  heads on the effective date of this section, the employee 
  1.22  retains the salary, but may not receive an increase in salary so 
  1.23  long as the salary exceeds the upper limit of the middle salary 
  1.24  range for agency heads.  
  1.25     As used in this subdivision, "salary" means hourly, 
  2.1   monthly, or annual rate of pay including any lump-sum payments 
  2.2   and cost-of-living adjustment increases but excluding payments 
  2.3   due to overtime worked, shift or equipment differentials, and 
  2.4   back pay on reallocation or other payments related to the hours 
  2.5   or conditions under which work is performed rather than to the 
  2.6   salary range or rate to which a class is assigned.  
  2.7      (b) Total compensation plans for unclassified employees of 
  2.8   the judicial branch shall be determined by the appointing 
  2.9   authority, unless other law provides a different method for 
  2.10  establishing this compensation.  Judicial branch compensation 
  2.11  plans shall be consistent with sections 43A.22 to 43A.30. 
  2.12     Sec. 2.  [EFFECTIVE DATE.] 
  2.13     Section 1 is effective July 1, 1996.
