  1.1                          A bill for an act 
  1.2             relating to education; adding a provision to 
  1.3             integration revenue; providing for special education 
  1.4             cross-subsidy aid; authorizing referendum revenue 
  1.5             restoration; appropriating money; amending Minnesota 
  1.6             Statutes 2000, sections 124D.86, subdivision 3; 
  1.7             126C.17, by adding a subdivision; proposing coding for 
  1.8             new law in Minnesota Statutes, chapter 125A. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 124D.86, 
  1.11  subdivision 3, is amended to read: 
  1.12     Subd. 3.  [INTEGRATION REVENUE.] For fiscal year 2000 and 
  1.13  later fiscal years, integration revenue equals the following 
  1.14  amounts: 
  1.15     (1) for independent school district No. 709, Duluth, and 
  1.16  independent school district No. 535, Rochester, $207 times the 
  1.17  adjusted pupil units for the school year; 
  1.18     (2) for independent school district No. 625, St. Paul, $446 
  1.19  times the adjusted pupil units for the school year; 
  1.20     (3) for special school district No. 1, Minneapolis, $536 
  1.21  times the adjusted pupil units for the school year; and 
  1.22     (4) for a district not listed in clause (1), (2), or (3) 
  1.23  that is required to implement a plan according to the 
  1.24  requirements of Minnesota Rules, parts 3535.0100 to 3535.0180, 
  1.25  the lesser of 
  1.26     (i) the actual cost of implementing the plan during the 
  1.27  fiscal year minus the aid received under subdivision 6, or 
  2.1      (ii) $93 times the adjusted pupil units for the school year.
  2.2      Any money received by districts in clauses (1) to (3) which 
  2.3   exceeds the amount received in fiscal year 2000 shall be subject 
  2.4   to the budget requirements in subdivision 1a. 
  2.5      Sec. 2.  [125A.795] [SPECIAL EDUCATION CROSS-SUBSIDY AID.] 
  2.6      For fiscal year 2002 and later, a school district shall 
  2.7   receive an amount of aid equal to a district's unfunded special 
  2.8   education costs that have been cross-subsidized by a district's 
  2.9   general education revenue as documented by the most recent 
  2.10  report to the commissioner under section 123B.143, subdivision 
  2.11  1, clause (5). 
  2.12     Sec. 3.  Minnesota Statutes 2000, section 126C.17, is 
  2.13  amended by adding a subdivision to read: 
  2.14     Subd. 13.  [REFERENDUM REVENUE RESTORATION.] (a) 
  2.15  Notwithstanding any law to the contrary, a school district is 
  2.16  eligible to increase its referendum revenue allowance by the 
  2.17  amount under paragraph (b) if: 
  2.18     (1) the district had a referendum allowance reduction under 
  2.19  subdivision 12 in fiscal year 2001; 
  2.20     (2) the referendum authority to which the reduction was 
  2.21  applied has not expired; and 
  2.22     (3) the school board adopts a resolution authorizing the 
  2.23  referendum revenue restoration. 
  2.24     (b) A school district's referendum restoration authority 
  2.25  equals the district's referendum allowance reduction in fiscal 
  2.26  year 2001, times the residential marginal cost pupil units for 
  2.27  the current year.  This subdivision is effective for revenue for 
  2.28  fiscal year 2002 and thereafter. 
  2.29     Sec. 4.  [APPROPRIATION.] 
  2.30     $....... in fiscal year 2002 and $....... in fiscal year 
  2.31  2003 are appropriated from the general fund to the commissioner 
  2.32  of children, families, and learning for special education 
  2.33  cross-subsidy aid under section 2.
