  1.1                          A bill for an act 
  1.2             relating to the legislature; proposing an amendment to 
  1.3             the Minnesota Constitution, article XI, section 6; 
  1.4             changing state fiscal biennium used for purposes of 
  1.5             issuing certificates of indebtedness; limiting the 
  1.6             odd-numbered year session; providing for reconvention 
  1.7             on extraordinary occasions; proposing coding for new 
  1.8             law in Minnesota Statutes, chapter 3. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.11     An amendment to the Minnesota Constitution, article XI, 
  1.12  section 6, is proposed to the people.  If the amendment is 
  1.13  adopted, article XI, section 6, will read: 
  1.14     Sec. 6.  As authorized by law certificates of indebtedness 
  1.15  may be issued during a biennium, commencing on July 1 in each 
  1.16  odd-numbered even-numbered year and ending on and including June 
  1.17  30 in the next odd-numbered even-numbered year, in anticipation 
  1.18  of the collection of taxes levied for and other revenues 
  1.19  appropriated to any fund of the state for expenditure during 
  1.20  that biennium. 
  1.21     No certificates shall be issued in an amount which with 
  1.22  interest thereon to maturity, added to the then outstanding 
  1.23  certificates against a fund and interest thereon to maturity, 
  1.24  will exceed the then unexpended balance of all money which will 
  1.25  be credited to that fund during the biennium under existing 
  1.26  laws.  The maturities of certificates may be extended by 
  1.27  refunding to a date not later than December l of the first full 
  2.1   calendar year following the biennium in which the certificates 
  2.2   were issued.  If money on hand in any fund is not sufficient to 
  2.3   pay all non-refunding certificates of indebtedness issued on a 
  2.4   fund during any biennium and all certificates refunding the 
  2.5   same, plus interest thereon, which are outstanding on December 1 
  2.6   immediately following the close of the biennium, the state 
  2.7   auditor shall levy upon all taxable property in the state a tax 
  2.8   collectible in the ensuing year sufficient to pay the same on or 
  2.9   before December 1 of the ensuing year with interest to the date 
  2.10  or dates of payment. 
  2.11     Sec. 2.  [SUBMISSION TO VOTERS.] 
  2.12     The amendment shall be submitted to the people at the 2002 
  2.13  general election.  The question submitted to the people shall be:
  2.14     "Shall the Minnesota Constitution be amended to change the 
  2.15  state fiscal biennium used for purposes of issuing certificates 
  2.16  of indebtedness so that the biennium begins and ends in the 
  2.17  even-numbered years rather than in the odd-numbered years, 
  2.18  commencing in 2006?  
  2.19                                     Yes .......
  2.20                                     No ........"
  2.21     Sec. 3.  [3.013] [ODD-NUMBERED YEAR ORGANIZATIONAL SESSION; 
  2.22  EXTRAORDINARY OCCASIONS.] 
  2.23     In the odd-numbered year the legislature shall meet in an 
  2.24  organizational session for not exceeding 30 days.  The 
  2.25  legislature shall convene in the even-numbered year on the first 
  2.26  Tuesday after the first Monday in January.  When the first 
  2.27  Monday in January falls on January 1, the legislature shall 
  2.28  convene on the first Wednesday after the first Monday.  The 
  2.29  legislature may reconvene on extraordinary occasions in the 
  2.30  odd-numbered year if authorized by written agreement of the 
  2.31  speaker of the house and the senate majority leader or by 
  2.32  petition signed by a majority of the members elected to each 
  2.33  house. 
  2.34     Sec. 4.  [IMPLEMENTING LEGISLATION.] 
  2.35     The legislative coordinating commission, or a joint 
  2.36  subcommittee appointed by the commission, shall prepare 
  3.1   legislation and other recommendations by January 1, 2002, to 
  3.2   implement section 3.  Existing legislative staff offices and the 
  3.3   departments of finance and revenue and other executive agencies 
  3.4   as needed shall provide staff assistance in developing the 
  3.5   legislation and recommendations. 
  3.6      Sec. 5.  [EFFECTIVE DATE.] 
  3.7      Section 3 is effective commencing with the legislature 
  3.8   convening in January 2005, and thereafter.  Section 1 is 
  3.9   effective, upon ratification by the people, commencing with the 
  3.10  biennium beginning in 2006.
