1.1 A bill for an act 1.2 relating to education; modifying the composition of 1.3 the school site decision-making team; amending 1.4 Minnesota Statutes 1998, section 123B.04, subdivision 1.5 2. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1998, section 123B.04, 1.8 subdivision 2, is amended to read: 1.9 Subd. 2. [AGREEMENT.] (a) Either the school board or the 1.10 school site decision-making team may request that the school 1.11 board enter into an agreement with a school site decision-making 1.12 team concerning the governance, management, or control of the 1.13 school. A school site decision-making team may include the 1.14 school principal, teachers in the school or their designee, 1.15 other employees in the school, parents of pupils in the school, 1.16 representatives of pupils in the school, or other members in the 1.17 community. The school site decision-making team shall include 1.18 the school principal or other person having general control and 1.19 supervision of the school. The site decision-making team must 1.20 reflect the diversity of the education site. No more than 1.21 one-half of the members shall be employees of the district 1.22 unless an employee is the parent of a student enrolled in the 1.23 school site, in which case the employee may elect to serve as a 1.24 parent member of the site team. 1.25 (b) School site decision-making agreements must delegate 2.1 powers, duties, and broad management responsibilities to site 2.2 teams and involve staff members, students as appropriate, and 2.3 parents in decision making. 2.4 (c) An agreement shall include a statement of powers, 2.5 duties, responsibilities, and authority to be delegated to and 2.6 within the site. 2.7 (d) An agreement may include: 2.8 (1) an achievement contract according to subdivision 4; 2.9 (2) a mechanism to allow principals, or other persons 2.10 having general control and supervision of the school, to make 2.11 decisions regarding how financial and personnel resources are 2.12 best allocated at the site and from whom goods or services are 2.13 purchased; 2.14 (3) a mechanism to implement parental involvement programs 2.15 under section 124D.895 and to provide for effective parental 2.16 communication and feedback on this involvement at the site 2.17 level; 2.18 (4) a provision that would allow the team to determine who 2.19 is hired into licensed and nonlicensed positions; 2.20 (5) a provision that would allow teachers to choose the 2.21 principal or other person having general control; 2.22 (6) an amount of revenue allocated to the site under 2.23 subdivision 3; and 2.24 (7) any other powers and duties determined appropriate by 2.25 the board. 2.26 The school board of the district remains the legal employer 2.27 under clauses (4) and (5). 2.28 (e) Any powers or duties not delegated to the school site 2.29 management team in the school site management agreement shall 2.30 remain with the school board. 2.31 (f) Approved agreements shall be filed with the 2.32 commissioner. If a school board denies a request to enter into 2.33 a school site management agreement, it shall provide a copy of 2.34 the request and the reasons for its denial to the commissioner. 2.35 Sec. 2. [EFFECTIVE DATE.] 2.36 Section 1 is effective July 1, 2000.
