A bill for an act
relating to higher education; proposing an amendment
to the Minnesota Constitution, article XIII, section
3; establishing the size of the Board of Regents of
the University of Minnesota; providing for elections;
proposing coding for new law in Minnesota Statutes,
chapter 137.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin CONSTITUTIONAL AMENDMENT.

new text begin An amendment to the Minnesota Constitution is proposed to
the people. If the amendment is adopted, article XIII, section
3, will read:

Sec. 3.

All the rights, immunities, franchises and
endowments heretofore granted or conferred upon the University
of Minnesota are perpetuated unto the university. new text begin The
government of the University of Minnesota shall be vested in the
Board of Regents. The Board of Regents shall consist of 15
regents, with at least two regents elected to represent the
state at large at each election by the legislature.

Sec. 2. new text begin SUBMISSION TO VOTERS.

new text begin The proposed amendment shall be submitted to the people at
the 2006 general election. The question submitted shall be:

new text begin "Shall the Minnesota Constitution be amended to specify the
size of the Board of Regents of the University of Minnesota at
15 regents and to require at least two regents elected to
represent the state at large at each election by the legislature?

Sec. 3.

new text begin The Board of Regents shall
consist of 15 members. At least seven of the members must
represent the state at large, including one university student
elected under section 137.023. The remaining members of the
Board of Regents must be residents of the state's congressional
districts under section 137.024. Beginning with the legislative
election of regents in 2007, at least two members of the Board
of Regents must be elected to represent the state at large.
