A bill for an act
relating to energy; requiring commissioner of commerce to construct accessible
database reporting energy use in public buildings; appropriating money;
proposing coding for new law in Minnesota Statutes, chapter 216C.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) Terms used in this section have the meanings given
them in this subdivision.

new text begin (b) "Commissioner" means the commissioner of commerce.

new text begin (c) "Weather-normalized" means the adjustment of annual energy use to account for
the differences in the actual average daily temperatures experienced in a given year in the
geographical location where the energy use takes place and an average temperature year.

new text begin (a) The commissioner shall develop and maintain a
Web site with a searchable database that is accessible to the public on energy use in all
buildings owned by the state and any political subdivision. The commissioner shall create
the database from data obtained from political subdivisions reporting energy use in public
buildings. The commissioner may add to the database any information the commissioner
deems appropriate. At a minimum, the database must be searchable by building name;
statutory or home rule charter city, and county where the building is located; and building
owner.

new text begin (b) The database must include at least the following data:

new text begin (1) name of the building;
new text end

new text begin (2) name of the political subdivision that owns the building;
new text end

new text begin (3) building location, including street address;
new text end

new text begin (4) square footage of the building;
new text end

new text begin (5) building construction type and building use;
new text end

new text begin (6) total energy consumed for heating, actual and weather-normalized, by type of
heating fuel used;

new text begin (7) total electricity consumed;
new text end

new text begin (8) total heating energy consumed per square foot, actual and weather-normalized,
expressed in units of heating fuel used per square foot and millions of BTU's per square
foot;

new text begin (9) total electricity consumed per square foot, expressed in kilowatt-hours per square
foot;
new text end

new text begin (10) corresponding data for clauses (8) and (9) for a building of the same type that
meets the specifications of Minnesota's energy code, contained in Minnesota Rules;

new text begin (11) the percentage by which the building's heat and electricity use per square
foot, as reported in clauses (8) and (9), respectively, is less than or greater than the
corresponding values for a building of similar type meeting Minnesota's energy code, as
reported in clause (10);

new text begin (12) total cost paid for energy consumed for heating;
new text end

new text begin (13) total cost paid for total electricity consumed;
new text end

new text begin (14) corresponding data for clauses (12) and (13) for a building of the same type that
meets the specifications of Minnesota's energy code; and

new text begin (15) the percentage by which the total cost of the building's heat and electricity use
per square foot, as reported in clauses (12) and (13) respectively, is less than or greater
than the corresponding values for a building of similar type meeting Minnesota's energy
code, as reported in clause (14).

new text begin (c) The data base must also contain Internet links to the Web site and the phone
number of the utility serving the building and to the Department of Commerce's Web site
for the conservation improvement program, as described in section 216B.241.

new text begin The report must be in a portable document format or
similar format, and must be no more than two pages in length, in easily readable type.

new text begin The database described in subdivision 2 must contain
complete data and be accessible to the public by June 30, 2009, for state buildings.

Sec. 2. new text begin APPROPRIATION.

new text begin $....... is appropriated to the commissioner of administration from the energy and
conservation account for the purposes of section 1. This appropriation does not lapse and
is available until spent.

new text begin Sections 1 and 2 are effective the day following final enactment.
