A bill for an act
relating to public safety; requiring a predatory offender to provide notice of the
offender's status to the head of any school where the offender is enrolled as a
student; amending Minnesota Statutes 2020, section 243.166, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 243.166, is amended by adding a subdivision
to read:

new text begin (a) An offender who is enrolled in a school in the
state at the time a court imposes a registration requirement under this section and an offender
who seeks to enroll in a school located in the state shall disclose to:

new text begin (1) the school's principal or chief administrator the person's status as a registered predatory
offender under this section; and
new text end

new text begin (2) the law enforcement authority with primary jurisdiction in the community where the
school is located that the person is required to register as a predatory offender and will be
attending the school.

new text begin An offender seeking to enroll in a school located in the state must provide the notice required
under this paragraph prior to enrollment.

new text begin (b) A law enforcement authority who receives notice under paragraph (a) or who knows
that a person required to register under this section will attend a school shall notify the
principal or chief administrator of the school and deliver a fact sheet to the school's principal
or chief administrator containing the following information:

new text begin (1) name and physical description of the offender;
new text end

new text begin (2) the offender's conviction history, including the dates of conviction;
new text end

new text begin (3) the risk level classification assigned to the offender under section 244.052, if any;
and
new text end

new text begin (4) the profile of likely victims.

new text begin (c) If a school receives a fact sheet under paragraph (b) that includes a risk level
classification for the offender and, if the offender enrolls at the school, the school shall
distribute the fact sheet to:

new text begin (1) all employees;
new text end

new text begin (2) all parents of students of minors who attend the school; and
new text end

new text begin (3) all students who are 18 years of age or older.
