  1.1                          A bill for an act
  1.2             relating to air quality; providing authority for a 
  1.3             city to suspend operations of a stationary source 
  1.4             found to be a major source of hazardous air pollutants.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [AIR QUALITY PROTECTION; ACTION BY CITY 
  1.7   COUNCIL.] 
  1.8      (a) The city council of a city of the first class may order 
  1.9   and enforce the immediate suspension of operations at a 
  1.10  stationary source found to be a major source of hazardous air 
  1.11  pollutants until required modifications are completed to the 
  1.12  plant so that it is no longer a major source of pollutants. 
  1.13     (b) Before a city council orders a suspension of operations 
  1.14  under paragraph (a), the Minnesota Department of Health must 
  1.15  have completed a study and determined in its report that the 
  1.16  stationary source qualifies as a major source of hazardous air 
  1.17  pollution under the federal Clean Air Act, United States Code, 
  1.18  title 42, section 7412(a)(1). 
  1.19     (c) A suspension of operations ordered under paragraph (a) 
  1.20  must be lifted within 15 days after the Minnesota Department of 
  1.21  Health, in consultation with the Minnesota Pollution Control 
  1.22  Agency, determines that modifications to the plant will result 
  1.23  in the stationary source no longer being a major source of 
  1.24  hazardous air pollution. 
  1.25     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective the day following final enactment.
