  1.1                          A bill for an act
  1.2             relating to education; providing funding for 
  1.3             alternative programs based on learning year pupil 
  1.4             units; amending Minnesota Statutes 1994, section 
  1.5             124.17, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 124.17, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 4.  [LEARNING YEAR PUPIL UNITS.] When a pupil is 
  1.10  enrolled in a learning year program according to section 
  1.11  121.585, an area learning center according to sections 124C.45 
  1.12  and 124C.46, or an alternative program approved by the 
  1.13  commissioner, for more than 1,050 hours in a school year, that 
  1.14  pupil may be counted as more than one pupil in average daily 
  1.15  membership.  The amount in excess of one pupil must be 
  1.16  determined by the ratio of hours of instruction provided to that 
  1.17  pupil in excess of 1,050 to 1,050.  Hours that occur after the 
  1.18  close of the instructional year in June shall be attributable to 
  1.19  the following year. 
  1.20     Sec. 2.  [EFFECTIVE DATE.] 
  1.21     Section 1 is effective August 1, 1996.
