  1.1                          A bill for an act 
  1.2             relating to agriculture; exempting certain food 
  1.3             sellers from the food licensing law; amending 
  1.4             Minnesota Statutes 1994, section 28A.15, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 28A.15, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 9.  An individual who prepares and sells food that is 
  1.10  not potentially hazardous food as defined in Minnesota Rules, 
  1.11  part 1547.0002, subpart 16, at a community event or farmer's 
  1.12  market on ten or fewer days in a calendar year and with gross 
  1.13  receipts of $1,000 or less in a calendar year.  If food is 
  1.14  prepared in a kitchen that is not licensed or inspected, the 
  1.15  seller must post a visible sign or placard stating:  "Homemade 
  1.16  and not inspected."  This exclusion applies only when the places 
  1.17  of preparation and sale are in an unincorporated area or 
  1.18  statutory or home rule charter city or town with a population of 
  1.19  15,000 or less and are outside the metropolitan area as defined 
  1.20  in section 473.121, subdivision 2.
