A bill for an act
relating to agriculture; establishing a moratorium on the sale and use of certain
pesticides; proposing coding for new law in Minnesota Statutes, chapter 18B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) Effective January 1, 2017, a manufacturer shall not sell or offer for sale
any pesticides with the active ingredients clothianidin, imidacloprid, thiamethoxam,
dinotefuran, acetamiprid, thiacloprid, nithiazine, or fipronil within the state. This
paragraph expires on July 1, 2022.

new text begin (b) Effective July 1, 2018, a person shall not sell, offer for sale, or use pesticides with
the active ingredients clothianidin, imidacloprid, thiamethoxam, dinotefuran, acetamiprid,
thiacloprid, nithiazine, or fipronil within the state. This paragraph expires on July 1, 2023.

new text begin (c) By January 15, 2022, the commissioner of agriculture, in consultation with the
commissioners of natural resources and the Pollution Control Agency, shall report to
the legislature on: (1) the latest published and peer-reviewed evidence on whether use
of neonicotinoids and fipronil causes unreasonable adverse effects on honeybees, native
insect pollinators, and birds; and (2) the impacts, costs, and benefits to Minnesota's
agricultural economy, including pollination services and honey production, of resuming
the use of these insecticides.
